90 day rule - is filing classified as date the petition is received by USCIS?

Hi everyone!

 

My 90 day window is ending in a few weeks and we are aiming to file by the end of this week. I am having some last minute panic - can anyone confirm if the date the petition is actually physically received by USCIS (as per shipping confirmation) is the date it was filed? I know that USCIS sometimes take a while to issue receipts.

Check cashed and text confirmation received: 03/24/2020, case at MSC (National Benefits Center)

NOA 1 18 month extension received: 03/27/2020

Please fill your timeline.  Did you come with a K1?  Also, you marrried within 90 days of your entrance?  If so, it doesn't matter when you mail or they receive your AOS application (I am assuming this is what you are referring to).

November 2018 - K1 filed

May 2019 - K1 interview scheduled and packet sent to embassy

June 2019 - K1 interview, approved, and moved to USA

August 2019 - Married

September 2019 - AOS/EAD/AP filed

October 2019 - Biometrics Appointment

January 2020 - AOS RFE for birth certificate received and sent back

February 2020 - EAD/AP approved and got the card

October 2020 - EAD/AP renewal filed

November 2020 - EAD/AP renewal approved and got the card - AOS interview date issued

December 2020 - AOS interview, approved, and GC received

September 2022 - ROC filed
June 2024 - Biometrics Reused
July 2024 - Approved (NO INTERVIEW) and GC received.

Hi Fe,

 

Planning on filling it shortly :) I entered on a CR-1 and am removing conditions of residency, not doing adjustment of status.

I believe your "filing" date is whatever you have on the receipt as mailing it out and them receiving it, even if you don't have the NOA@Lucky Cat has more info on CR1.

Timeline

I have no idea how this works with USCIS.  Is it like filing taxes where a submission has to be postmarked by 11:59pm on April 15th?  I have no idea, so my only suggestion is to get it out as soon as possible to avoid any issues.
