My husband went for his visa interview and was placed on AP. Later the status changed to refused. He followed the instructions the CO provided at the end of the interview and was required to submit additional documents. He has submitted them and the date that the case was last touched was updated...however the status still says refused. Does anyone have experience with being contacted to submit your passport for a visa after refusal? They never collected my husband's passport so how will they contact him for it? Will he be contacted thru email, telephone call, a ceac message? What should we expect? Thank you.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That's not true. After the ban occurred there were some waivers granted and there were visas issued.

They didn’t collect his passport, and after the documents were submitted it says refused and you think it’s going to now be issued ? I’m confused ? That’s a simple 1+1. Am I crazy here?

 

Sign 1, there is an issue.....after the interview you go to AP, they do not collect your passport, and ask for more documents

 

Sign 2, after documents are submitted, no contact to submit passport

 

Sign 3, your account updates to refused 

 

Why would they update to refused, if you aren’t refused/denied ?

Your not going crazy. You are just lacking a little more knowledge of what is taking place. Let me explain.

 

On March 3, 2020 the notification for AP changed to read "refused" but in reality, it's refused only from the standpoint that you are in AP and lacking some documentation. Your "refused" is that you is technically that you do not have a case that has been fully adjudicated and is missing documentation. Once you submit what is being asked for in the 221(g) (documentation request) they will finish the adjudication of the application. Once that is complete then they will render their decision. Normally, the decision is approved. If you see dates changing in CEAC this signifies that someone is "touching" the record to finish the adjudication part which then leads to "issue" when the visa is issued. Only when it says issue are you approved. Many are told at the interview that they are approved but that is just a pad answer to move you along. The whole idea is being a obscured as possible as not to provoke an argument. So if I am the CO and I tell you that you are approved you are happy and move on. No problem. This process is the same as the old, same as the new. Nothing to worry about.

Some embassies would ask for the passport at the interview, but the embassy doesn't want to "house" the passport during this AP review stage. If they deny him then they have to deal with returning the passport. If they approve him, the send an email to him to send in the passport. This is not something that is new to the process. No concern on your part.

I understand but I believe the OP said it said changed to refused after he submitted the documents, and remains at refused. 
 

I do believe that is what she said, maybe I need to review. Thanks for the insight.

It's not going to change from "refused" until such time as the visa is set to "issued" or you receive a email stating that your visa has been refused and it's being returned to either NVC or USCIS. If you receive the email, then that's the case that it really is REFUSED.

The email will read as a denial not refused the AP remains refused. Sorry for that small error.
