Visitors Visa or Spousal Visa?

Does anyone know if you can apply for Visitors Visa if you are already married instead of Spousal Visa? If so will it be more difficult to adjust status if we decide to live in the US after he visits a few times?

   TO get a visitors visa your spouse must show that they have compelling reasons to not stay in the US. That is usually difficult when you have a spouse in the US 

This will not be over quickly. You will not enjoy this.

If he wants to visit while waiting, he can apply for a tourist visa. The odds are not with him to get one with a USC spouse, but  no harm in applying so long as he is honest.

If he wants to immigrate, he needs an immigrant visa like a CR-1/IR-1.

Thank you for the reply. This is new to us so we are not sure exactly what we should do. Where can I find the proper procedure for starting the CR-1 process?

I'd start with the guides on this website:

 

For each form, be sure to read the form and its instructions closely until you understand them. They are not difficult - most people on this website did it themselves - but also don't take it lightly either.

Ask questions as needed.

 

The first step is filing the I-130 packet.

Once approved (this will take several months to a year, on average, right now), it goes to NVC. NVC wiki: https://www.visajourney.com/wiki/index.php/NVC_Process

 

Once documentary qualified (DQ, or sometimes called CC (Case Complete)) at NVC, you will wait for a visa interview to be scheduled.

From this point onward, follow the directions from the consulate. The documents required, process, etc. vary from consulate to consulate. A medical will be required.

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received
