Couple questions about the I-130

Hello everyone. 

 

Hubby and I are starting to research and compile what we need to file his I130 down the line. We've been going through the form and are confused on how to answer a couple questions. Bit of background first. Hubby came to the US in 2008 on a K1 and we lived in the US until last May when we moved to the UK. We had planned to make this our home but have concluded we preferred our life back in the US. 

 

So, my questions relate to the following:

 

Part 2: Info about me with regards to my parent's info Town and county of residence. How do I answer this if both my parents are deceased? Do i put that in there or do i put which city/county they passed away in?

 

Beneficiary's entry. Asks for I94 info and date of expiration. However, when my husband entered the US last it was on the approved K1 visa. and he then had a successful AOS after we were married. Do we leave that blank?

 

Previous petition question. How do we enter this if we can't recall the exact date it was originally filed as it was over 12 years ago and he no longer has access to his online USCIS account. 

 

I'm sure we will have more questions down the line but these are the initial ones. We do plan to provide a cover letter explaining the fact he was a green card holder up until November 2019 as well.

I don’t know if you are aware that DCF through the London USCIS Office is only available for about 3 more weeks. That will be your easiest process. The office closes at the end of March.

Previous petition: your Visa Journey timeline says it was 2-25-2008

I'm guessing your filling online?

 

I'm writing this with my phone and noticed this question, but it's not the previous one. From what I understand, the paper version should be the exact same as the online version. So I'm guessing that you put the form i94 info if he is currently in the USA. Please look at the paper version in page 7.

Ahh forgot about my old timeline. We know about the DCF going away. We are fine with that. We spent so much getting over here that we need to resave before we try and move back. The documentation itself isn't an issue since we can use the I-864W, but we want to make sure we have our savings where it was before we left the US. :) 

 

Thank you for the answers. The parent one had us massively confused.

Actually we will be sending in the I-130 to the Texas lockbox when we are ready to file. But hubby never came to the US on an I94 since he came over on the K1. But we are no longer in the US as we moved over to the UK last May. We plan to move back to the US in a couple years. Just pre-planning.

K1 have an I-94.

Actually never mind about the I94 question. Just re-read the form and that part is filled out only if we are currently in the US. Which we are not. :)

Yes, I believe that is what he filed. We were required to as we had expectations of remaining out of the country for over 6 months (we were not sure how long we would be out of the US). It's why we know we will have to go the route of the IR-1. Thankfully we are eligible to fill out the I-864W when we are ready. Hubby earned over 40 quarters with Social Security.

So you are looking to move sometime next year?

No. We are looking at closer to 2022. We just like to pre-plan. I've found my answers to the questions I had so I think we are good on this end. Just waiting for the right time to file. :)
