Adjust of status with B1/B2 visa

Good morning.

 

I have a fiance from Germany and he received his B1/B2 visa about 2 years ago. He traveled to US serveral times for business and that's how we met.

 

since I met him I visited him few times and he did as well.  we've been talking where we want to settle down between Germany/US  while he was visiting me and we thought moving to Germany was better idea.

 

However, we were having extremely difficult time to get separated again (by him going back to his country) and we decided to get married and proceed with his visa process.

 

I've read online and a lot of people advised that it's not a good idea to try to apply green card with B1/B2 as immigration officer can doubt his intention wasn't for temporary stay.

 

but since the decision was made while he was here for 2-3 weeks and kind of spontaneous. is it really bad idea to get married and apply for his green card? he has good record of traveling to US with his B1/B2 visa and I thought it would be solid proof of his intention wasn't marriage to US citzen.

 

I understand that K-1 visa or spousal visa are a solid path without risk but we wanted to try something that can save us time.

If it’s truly “spontaneous” sure he can adjust. You guys realize he won’t be able to work or to travel outside the US until he gets his EAD/AP, can be up to 6 months, if you do it this way? What are his plans for sitting at home for 6 months? Not being separated is one thing but many people find this state of affairs limited and frustrating, not to mention often financially problematic.

Not working isn’t an issue. I do make enough income to support both of us. He is planning to study English himself while staying at home.
 

I really appreciate your concern though! For sure it’s something to be considered.
