I think you really need a good experienced immigration lawyer who ALREADY won cases like this. Really sorry to read your story. It’s craziness....it’s not the end and just a judge can decide about your immigration status. They have no right to say that documents were easy to set up...it means all people can do it?..crazy strange. So you have age difference and had you any immigration issues with USA before? Declined visas, etc? Any criminal cases, minor arrests?...

Look for pro bono or voluntary legal aid in your area. There are lawyers who will take cases at discounted rates (sliding scale based on income) or on a voluntary basis. Something about the interview seems like it threw them off. What were the divergent answers that were given? Were you able to check that with your spouse, did someone say the wrong date accidentally or confuse an important piece of info?

Our age difference is 1 year and I have never had any trouble with the Government. No declined visas, criminal cases nor arrests.
My spouse had a misdemeanor before we met, but thats it.

That threw us off.

Yes there were confusion and nervousness in the interview.
We said dates that didn't match as well as other information. I am new at my current job, and my wife said the wrong company name, for and example.

Me and my wife have really bad memory so some trivial information were wrong, like the clothes she was wearing the night before.
Another thing that definitely did not match was when the officer demanded an answer we did not have and we had to MAKE UP ONE so she could move on. Naturally those answers did not match.

Other answers like previous addresses, details about the house and our life, were fine.

Maybe the fact that my wife panicked at the interview and started crying after the officer start being rude and yell at her did not help my case as well...

I really wish you the best...it’s really strange situation. With this NOID what they send else? Can you send them more proof of bonafide marriage or should you appeal the decision directly to the court? 
You wife never was married to a foreigner before? No one got a citizenship through her? Where is really should be trigger for all this difficult case...Did you get RFE before the interview? How long they processed your 751 and which service center? Did you immigrate with K1 visa or changed status in the US from tourist visa?

Your inadequate preparation explains it.  Bad memory isn't an excuse.

 

In instances like these, interviewees can say, "Ma'am, I'm sorry if you're having a bad day.  Perhaps your supervisor can come to ask me a few questions."

 

Earlier in the thread, it was suggested that I had had a similar problem.  Our Stokes interview was at the [censored] Guayaquil consulate.  We had zero trouble with USCIS at the later stages.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We had a stokes for AOS but after my stepson called me daddy the CO was immediately nice and receptive

Answering all your questions....

With this NOID what they send else? They send only the noid.
   They printed all the statements we gave. Nothing more than that.
Can you send them more proof of bonafide marriage or should you appeal the decision directly to the court?
   I believe we can send more proof to try and argue against their decision. Tomorrow i'll meet a lawyer and shell have a more complete answer.

   Nope. For both of us, this is our first marriage.
Did you get RFE before the interview?
   No. The only RFE I ever received was during the AOS.
How long they processed your 751 and which service center?
   I sent the I-751 in August 2018. In October 2019 I submitted the N-400. In March 2020 we had the interview.
   Originally it was sent to be processed in CA. Then they send it over to TX. We live in Orlando.
Did you immigrate with K1 visa or changed status in the US from tourist visa?
   I applied for AOS from tourist visa.

Thats pretty much it. I hope there is still hope.

You are absolutely right. We should have prepared better and maybe trained in case we got pulled for a Stokes.
But I admit that the surprise of the interview being the way it was did not help the nerves.

If I only had had the wit to say what you've suggested, I wouldn't had think twice. Sincerely, that's what I should had done, if I knew such thing was possible.

But unfortunately we cannot change what's been done. Only thing we can do is work with what we have, which is the truth, which is we been living together, and trying convincing the government that.

It would be great if someone that had passed to a similar situation could give an input over here.

*Updates*

So, after that terrible interview we went after a lawyer who instructed us to answer the NOID as best as we could gathering as much new and supporting evidence as we could, not being shy regarding the amount of paper we would use. So we did it and the package arrived 1 day prior to the 30 day limit for an answer. Over 600 pages of new evidences, letters, answers, photos and lawyer's cover letter as well. 

That happened the end of May 2020. So far we hadn't heard from USCIS.

I understand the consequences of this pandemic and that things will take some time to get back on tracks, but so far we have been a little more than 1 year waiting for an answer, which is, once again, totally understandable taking into consideration what happened last year.

Overall, the whole process, since the adjustment of status, is taking more than 5 years.

I will post updates as soon as something happens.

Once again I would like to thank the kindness of everybody who helped us when we were lost after receiving that NOID.
You folks gave me strength and courage to keep going and face that challenge, and for that we are incredibly grateful.
This is a wonderful community and everybody here IS CHANGING PEOPLE'S LIFE FOR THE BETTER!
