2 different work visa from 2 employers

Hello,i have a really important question. Im currebtly with a h2b visa in Florida. Its valid till end of may. Employer A wants to sponsor me for the h2b visa and is ready to send all documents next week to the USCIS. My current Employer B is my favorite and hired extra a lawyer,they want to sponsor me for the O1 visa. But they send all the documents in 2 weeks to the USCIS. If the first one (h2b) gets approved can i still get approved for my O1 2 weeks later or will that automaticly be declined?

Very different but yes you can have 2.

If you want to work for more than one Employer you need more than one visa, well generally, H2b only allows you to work for that Employer. So is it unusual absolutely but 2 jobs 2 visa's.

Ok so you got me wrong. I dont want to work 2 jobs. My current employer wants to keep me very badly and thats why they hired a lawyer with premium service ect. The other employer with the h2b is in Boston. That visa is 100% safe but i would have to leave after that season and go back to germany. Thats why i ask if ciuld have a approved h2b in boston and a approved o1 in Florida and then i would choose the o1 of course. But in case i dont get the o1 i would still have the h2b. I hope you understand what i mean.

So it is one or the other, I am sort of surprised 2 Employers would want to do this but I can not see any harm.

Make sure they have a lawyer who knows what he or she is doing for the O.

H2b is generally low skilled, the exact opposite of O. I can see how a chef might fit both but O has particular requirements, it’s not just many years of experience.

I know what you mean,my lawyer is doing that since 40 years and the O1-B is a very good chance for chefs. I have all the evidence wich are needed together and we build a strong case. Its also about refferences and especially known chefs i worked for already who all wrote ne outstanding letters. Im very confident.

One last question,my lawyer told me that if my visa gets approved i dont havd to go to my homecountry for a second interview since i had already one when i came to the USA with my H2B visa. Further he said,my H2B visa is still valid for 2,5 month so we just transfer the type of visa? I red now here a couple of times that prople went home to their homecountry to have a interview. I never heard that.

A transfer is possible on a H1b to another Employer, so presumably possible for a H2b, or is this the O1?

I would stay with my current employer,and change from h2b to o1b. So for what i would have to go to germany for a second interview,never heard that but just red some posts here in the forum.

You said the lawyer has 40 years experience so I’d assume you would trust his advice.
