Filing for I131- reentry permit while waiting for renew 10yr green card

Hi everyone,

My mom has filed I-90 on may 2019, she got extension sticker on her old 10 year green card until may 2020. Can she still file for I-131 reentry permit with her old green card with extension sticker?

or does she need to wait for her new green card arrive and then apply for reentry permit?

Remember that permanent residency is separate from the physical green card. Your physical green card may expire, it does not mean your permanent resident status has changed. The card is just evidence of permanent residency.

 

With that in mind I do not see any reason why she cannot apply for reentry permit with the extension sticker. Go ahead and apply. I cannot understand why the processing time for I-90 is about 12 months. Totally unacceptable. USCIS seriously needs restructuring because what is going on is worse than third world countries!

The processing time for I-90 is from 10 months to 12.5 months. I just read the I-131 instruction. They said if your renew green card application is still pending, I could include the I-797 notice of action and front and back of my mom old green card when filing the I-131

I guess that should be fine.

Thank you though, trump and corona virus is the worst combination for immigrant at this time. Hope we can pull through
