J1 waiver 2020 NOS update timeline

Hi all,

 

my case was finally approved by USCIS on 16th of November. I've mailed the documents to DoS in May -- you can find my complete timeline on this thread. However, since my application, I've changed continents and the update of the address failed. What I did was a redirect to a friend. (through USPS). In this way, I managed to get my case number from USCIS and I've tracked my case on USCIS website. Unfortunately, the final approval from USCIS seem lost, despite the USCIS' website showing that my case was approved. I spoke with an USCIS representative and I was advised to fill in a form (for a mere $400) in order to have my approval/waiver delivered somewhere else.

 

My question to you is: how does the waiver look like? (Is it different than the I-797C approval?) and, when filling other forms (e.g., I-485/consular processing), do I need a physical copy of the waiver? Is the approved case number with USCIS enough?

 

I find it strange to send a form to USCIS to receive another form that they need.

It's a i-612 form that waves the residency requirements.

 

Yes, you will the waiver at a consulate or anything related to immigrant visas (e.g. H1B, spousal visa) or green card application.

For anyone wondering at what stage of waiver can they apply for H1B: My visa advisor (cap-exempt research position) told me she needs I-612 approval notice. Then my DS2019 was about to expire, and she applied for H1B using a screenshot showing DoS FR! My best hope was an RFE for the approval notice. H1B was approved in 8 days, no RFE!

After months of waiver pending, this was the best thing that could happen!

Thanks. I am planning of asking my visa advisor to do the same (if I get FR, and on time)..

There is the I-797C notice of action and the I-797 approval notice which mentions that its for I-612. There is no separate I-612, I don't think. Please correct me if this is wrong.

You're right! I just checked what my lawyer said, and it's "You will receive the DOS Recommendation and then the I-797 (indicating I-612 receipt and approval) from USCIS."

 

So my process is done! I got both I-797C and I-797 on the same day. 797C was issued 4 days before 797.

Could you please post your complete timeline? Was it NOS-based application?
