Contacting senators/reps people really don't do much on Waivers. Each waiver case is unique and needs its own internal processing arrangement. Senators can only help expedite a waiver case that is based on Hardship to a US citizen or persecution. IGA can help expedite a case that based on state/govt request.

I mailed all my J1 waiver documents to the Department of State on July 6th. The indian embassy sent my NOS statement on July 14th. My case is not even showing up on the J1 waiver status webpage. What do I do now?

Spend sometime and read other people’s experience each experience is unique. They do not start counting the 12 to 16 until after the receipt date. For example I sent my documents June 15th the received it June 18th it didn’t appear on their portal until August 11 that’s approximately 2 months. They have 12 to 16 weeks before they are compelled to provide feedback. I was lucky I got my FR favorable recommendation on August 24. I encourage you to read other experiences it will bring a better understanding of this journey. Trust me, read it’s good therapy you will need it for this journey.

From what I know,   you should look into next month for things to begin to show online.  Patience is the name of this stage of the process. It will show but not just when you want.  Please read previous experiences, they will bring hope and calm your fears.

Hi all,

 

I sent all the documents to DoS on 25th of May (2021) and they showed up on their website in the first days of July. My embassy sent (via e-mail) the NOS twice, on 29th of May and on 7th of July. However, even to date (31st of August) the NOS doesn't show up on their website.

 

Anyone else finding a big delay (3 months+) before the website reflects the NOS? My J1 expires mid October.

 

I find this process one of the worse: no transparency whatsoever, random delays, no answers, and misleading information (e.g., website says "that 12-16 weeks after we received all the documents", should be "12-16 weeks after an arbitrary, unknown point in the future when we feel like we'll update the case to reflect the document that we received"). I understand that the COVID19 situation slow things down, but the process seems really broken to me.

 

I've asked twice DoS via e-mail about the status of my NOS and I never received a response back (except the two automatic e-mails with contradictory information -- "we'll get back to you in 10 business days" and then "we'll get back to you in 25-30 days"). I've tried to ask help from two senators and none of them were able to help (my experience is that they can help once the case is at USCIS, but not so much when it is at DoS).

 

Finally, I have more than four J1s, do you think that this may cause a delay? None of them were government sponsored.

DOS states that it is 12-16 weeks after all documents have been marked as received on the website (including NOS). This does not mean the day the receive it at the lockbox in Missouri. You just need to be patient... I got my FR 12 weeks after my NOS was received, but 21 weeks after all my documents were delivered.

2/6/24: I-751 packet shipped via FedEx

2/7/24: Delivered and signed for

2/9/24: Text message with IOE receipt number received at 12:26pm

2/13/24: I-797 48 month extension letter and biometrics reuse letter available online, case updated to "actively being reviewed"

Adjustment of Status (5 months)
9/13/21: AOS packet shipped via FedEx

9/15/21: delivered and signed for

9/17/21: 4 text messages with IOE receipt numbers received at 8:45pm

9/24/21: Received 4 receipt notices in the mail and online access code

9/25/21: Biometrics scheduled for Philadelphia, ASC

10/18/21: Biometrics appointment completed for I-485 and I-765 (Code 3)
10/18/21: After biometrics, I-485 and I-765 case statuses immediately changed to "case is being actively reviewed"

10/28/21: I-693 deficiency notice uploaded online, case status still, "case is being actively reviewed"

12/29/21: Interview scheduled. Contacted Emma agent and they said it is on 2/7/22

2/7/22: I-485 approved

2/12/22: I-797 approval notice received for I-485 and I-130

2/15/22: Green card delivered by USPS

To be more precise, the website claims that "The processing time for your application begins when your file is complete" and "Your file is complete when we have your waiver application, processing fee, copies of DS-2019/IAP-66 forms (Step 2), and all required documents (Step 3)."

The NOS was delivered via e-mail, so I kind of assumed there is no lock-box involved (or equivalent). Having a system, where you send a simple document via e-mail that gets reflected into some database 3 months+ later, is absurd for these times. But hey, the logic is unknown in this process, so probably I was wrong 🙂.

 

I see that you've managed to update your NOS on their website, less than two months after your embassy sent the NOS (by re-sending your docs). Congratulations on this feat! 🙂 Have you resent the NOS along with your docs? Did your embassy send the NOS via e-mail (to DoS)? I guess it was all luck at that point (the senator was meaningfully involved later in the process).

Why did you send J1s that are not government sponsored. I was told that I should only send the ones that has two-years rule. Thank you!

All my DS2019 forms were not government sponsored but each of them were subjected to two-year rule. According to the second bullet from Step 2 from here, you need to submit all DS2019 forms ever issued to you.

I have some DS-2019 which are not subject to two-year rule, therefore I did not submit them.
