Hi All

I applied for J1 visa waiver and got favorable recommendation on February 11th ,2021  and I got a notice ( Form I-797C)  from USCIS on February 18, 2021 saying that they got my application but I did not received any update since then . When I check online in USCIS website it just says Case Was Received at another USCIS Office.  Is it normal for my case to be pending with USCIS almost one month now? From what I have seen in the forum, it should take one or two week for USCIS to reach it's final determination and send approval. Is there any one here who has similar time like me?  My case is NOS .

Thank you

Did you have to fill out a I-612 form or is that done by the DoS and sent to the USCIS?

Hi @Mlle_Wanderlust I filed only the DS-3035 and applied with the state department. My case category was NOS, so there  was no need to fill I-612 form. You are required to fill I-612 form and submit to USCIS if you are applying under the categories of Extreme hardship or Persecution.  Good luck!

For NOS, DOS sends the FR electronically to USCIS. I didn't receive a hard copy of FR. Typically, you don't have to do anything.

I got FR sent on 03/25. I received notice of action I-797 on 3rd of april from USCIS. Using the receipt code on I-797 I chcked the status on uscis website, and it said my case was already approved from USCIS. So now waiting for hard copy in my hand.

Good Luck

I'm applying for a J-1 Waiver under no objection. The documents from myself and the no objection statement from the Embassy were received in  late December.

Today, I got an email asking for copies of my passport, proof of payment and the DS-2019. I already submitted these documents!

Has anyone else had the same issue? If so, how long did it take once you emailed them copies for the second time?!

Thanks!

Finally I got my recommendation. DOS seemed to expedite it due to having messed up and not requested the sponsor views for so long

Hi,

First of all congratulation. Did you have to leave the US and go back to France after your DS-2019 expired??? Are you applying to an H-1B visa now from France??? is there any appointment at  the US embassy??

I am in kind of in the same situation and my visa expires on May 01, 2012 and my application process started on October 06, 2020. After contacting then several times, they finally got to my application and they are requesting that in addition to my home country No objection letter (sent by the Algerian Embassy) they need an additional NO letter from France (Country where I was a temporary resident with a student status when I applied for the J-1).

I did not, I stayed in the US the whole time. My H1B sponsor filed the application before the grace period ended, so I was able to stay (without being able to work). Once USCIS approves the J1 waiver, we're going to expedite the H1B so I can return to work asap

good luck with your application!

My H-1b application is only missing the DoS letter and the USCIS letter. Can I file before receiving them????

My sponsor did - but only wants to file the expedited case once they have the USCIS letter

I haven't handled any of the H1B paperwork, the sponsor did everything for that

@JMCPMT

My sponsor is also filing my H1B for this year, i got picked. I got approved waiver already.

My only problem now is that my J-status finishes on May 31st this year and up to 30th June for 30-day grace duration.

When is your DS2019 expired?

I am figuring out if I have to change my status for the gap between July 1st to Oct 1st.

Thanks

My DS209 expired on Feb 7, 2021, with the grace period ending on Mar 7.

I cannot say much about what happened on the H1B side. My employer told me they filed the paperwork (during my grace period) and that I was able to legally stay, and that my H1B will officially begin when it is approved after the expedition (hopefully in May or June)

If you’re doing expedited H1B I believe it should only take 2 weeks until you are ready, which is before you grace period so I believe you are good. However, I’m not a lawyer. I don’t know if you don’t get your H1B until October, sorry
