Did you talk to your lawyer about the meaning of “not subject”? I’m still waiting for my letter, and I’m thinking about reaching out to a lawyer if I don’t get it soon

Expect a generic letter that says that you are not subject to 212(e) because none of the conditions are satisfied. Not clear to me how a lawyer can help you at this stage - do you want to sue DOS to mail your letter immediately? By the time you had a consultation,  retained an attorney and they start work on your case you'll have received your letter.

October - update

 

So I just checked my status and I finally got an update (my documents were delivered to DoS on Oct. 15th 2021):

 

[February 28th 2022]

Except for the NOS, all documents are being displayed as received. The date on the system shows February 24th and 25th for some documents. 

 

[March 2nd 2022]

NOS is now displayed as received. The date on the system shows the NOS update on February 28th.

Dear All, 

 

My documents reached St Louis on November 15th, the check cashed on November 18th. As if a surprise, no update in the system as of now. 

 

Glancing over the blog, it does not seem like the process is becoming any more efficient. It goes without saying that waiver is increasingly an urgency for several of us. How about writing individually to the respective congressman/ woman? A sample is attached.

 

It may only be a large scale request which makes an impact. Me and a friend of mine have already written to the corresponding congressman.

My friend, who submitted around early November, which is about a week later than me, got updated with a received date as Feb 28 for NOS.

 I just hope my update would show soon and earlier date.

But I did not get with the earlier date

Do you think everybody who is even working on a NIH sponsored project with PI will get a opinion request from DoS? Or is it direct NIH funded postdoc?

Sadly, then they update randomly not by the date they actually received.

Yes. Please see my timeline above. I got an update on March 04- and the documents show up with March 03. Sent my docs in Oct 2021

Hi Group,
Has anyone extended their J-1 visa after applying for J-1 waiver? I am planning to extend my visa given the J-1 waiver is taking forever.
My concern is that I will have to send the updated DS forms to DoS and that might take additional time. Can anyone please share their experience?
