J1 waiver 2020 NOS update timeline

Has anyone experienced this? I found one thing online and they said they received a letter from DOS saying:

 

"The Department has determined that the above exchange visitor is not subject to the 2-year residency requirement of Section 212(e) of the Immigration and Nationality Act, as amended, based on the following data"

yup people are right, it seems you didn't even need to file for the waiver in the first place. Congrats!

So you sent the documents on October?

 

I sent all my documents on August, there was no updates for months, then in late November the website was updated showing my documents was received on October. 

 

It is possible you will see an update soon, and it can show that your documents were received in December or something. Then the waiting time will begin. I'm really sorry we are all waiting this long for this thing.

You're not alone. My package was delivered on Oct 15, 2021 and no updates at all.

Check your DS-2019 thoroughly once more. It should clearly say that if you are subject to the 2-year rule or not.

Since the J1 waiver department has determined that you are not subject to the rule, then that just may be it, unless it is clearly shown on your DS-2019.

 

Attached is a snapshot of my DS-2019 where it is seen clearly about the 212 e rule.

Not always the case. My DS-2019 said I was not subject but in the end I was. It all comes down to DOS.

If DOS says you're not subject, then save the letter where they state it and attach to whatever you're planning to do (adjustment of status or changing visas).

Out of curiosity, what was your actual finding? The "indirect government funding" is quite a vast gray area and it would be helpful to other exchange visitors where the WRB draws the line.

I have seen a lot of people needing waiver even though they did not receive any funding. My funding is kinda complicated to explain, but it is more of a student loan.

 

When I receive my letter in the mail I will update here so if anyone ends up in the same situation they will know what it means.

10/12/2021: Documents mailed to St. Lous

10/29/2021: Embassy delivered non-objection statement to US Department of State

2/16/2022: J-1 waiver tracker shows various documents - but not the non-objection statement - as received (dated 2/15/22)

2/23/2022: Lawyer contacts the Waiver Review division to inquire about the non-objection statement.

2/25/2022: J-1 waiver tracker shows non-objection statement as received (dated 2/14/22), finds me not subject to 212e, and shows a 212e finding letter was sent (dated 2/24/22).

Did your status go from "Pending" to "Not Subject" on DOS page? 

I got that and it said Finding Letter sent, I am just not sure what this means? My status got updated to that last week, but I have not received any letter yet and not exactly sure what's next since I haven't seen this happen to many people.
