From my observations of the posts and my own experience (18 weeks), unfortunately your experience appears to be within the currently expected processing time from receipt to first update.

I have a question related to a J1 waiver and green-card process. Currently, my status for a waiver is pending. My fiancé and I are planning to get married in the US through the K1 visa. Can he file a petition I-129F even though I have not gotten my J1 waiver yet? At what point are we showing our J1 waiver?

I just got an update on DOS and I'm kinda scared,

 

My status went from "Pending" to "Not Subject" and it says 212(e) Finding letter is sent. 

Has anyone experienced this? I found one thing online and they said they received a letter from DOS saying:

 

"The Department has determined that the above exchange visitor is not subject to the 2-year residency requirement of Section 212(e) of the Immigration and Nationality Act, as amended, based on the following data"

Thanks for the info. Almost 99.9% NOS-based waiver are approved, but still they want everyone to go through this time consuming process. Why? It doesn't make any sense to me. They shouldn't do it if they can't process it in timely manner. 

We are putting food in the plate of the people who process these things, an still they are giving such a hard time. Shame on these people.

Check your DS-2019 thoroughly once more. It should clearly say that if you are subject to the 2-year rule or not.

Since the J1 waiver department has determined that you are not subject to the rule, then that just may be it, unless it is clearly shown on your DS-2019.

 

Attached is a snapshot of my DS-2019 where it is seen clearly about the 212 e rule.

I hope you are indeed not subject to this stupid 212e. Keep us posted.

It does say it on my DS-2019 that's why I'm confused. It is marked for government financing. But if they say I'm not and end my case what can I do?

Congratulations!

 

The waiver review board likely determined that the consular officer that orginally found you subject to 212e was incorrect. Since you're not subject, no waiver is needed.

My DS-2019 is also endowed with the 212e finding (consular officer determined so during the visa interview). My lawyer told me that I did not receive government funding (and declared this on the DS-3035); but that applying for the waiver would nonetheless the best approach in this situation. Your experience would seem to confirm this.

 

Out of curiosity, what was your actual finding? The "indirect government funding" is quite a vast gray area and it would be helpful to other exchange visitors where the WRB draws the line.
