You will need the waiver to get the visa stamp. Reading your post, it looks like you are in J-1 status currently, so change of status is out of the question. The second part of your post is something that can get you in a lot of issues - your best bet is to get the waiver and then the work visa, or fulfill the two year requirement.

I don't have any status right now. I relocated in another country and have no idea what to do with my approved h1b :D this waiver is taking forever and have no hope that it get's approved

You can't do anything with the approved H1 until you get the waiver/complete the 2YHRR requirement.

I think you're in the process since long time. Hold tight.. it will get sorted out soon. Was you in the US at the time of applying for the waiver? How long you have been out of the US?

Yes, I was still in the US, but left soon after. I sent out all documents later July 2021 and left the US in August. 
I applied for the waiver after I got h1b case approval. H1b is valid since 10/01/2021

Your approval notice should contain information on the validity of the approval - keep that in mind for your plans.

This was specifically for @Lako - an approval has a validity period and in some circumstances can expire if not acted upon.

 

Whether or not you can apply for H-1B depends on what status you're currently in. As mentioned earlier in the thread, you can't apply for the work visa change-of-status/new visa stamp if you are currently in J-1 status and haven't completed the 2YHRR requirement or have a waiver.

@BrunoJ1 @SomeoneNamedIan @WGLKID @Hdd @qwerqwer We all are October 2021 applicants. Anyone of you have any update on your case? I do not see even a first update (documents received) as of now. 

 

@iwantmywaiver @etcoflife are also October applicants. @iwantmywaiver was first week of Oct, and @etcoflife is last week of Oct. They both see there case as received on the waiver portal.

No updates for me. My case is still empty. Any chances they actually lost it?

As of today (2/9/22), "Currently, there is no information regarding the status of your case."

I have no updates. I'm expecting to see it in this week. I'm just worried if they lost my docs.

No new updates. The last one was NOS received on January 10th.
