Submitted I-824 to forward my case to NVC after the I-130 was approved.

Does anyone experienced this: Iam a U.S. Citizen, my I-130 Petition for Alien Relative for my mom and son under 21 was approved last Dec. 2, 2019. And I received I-797 Approval Notice that tells me what to do next, since my mom and son is outside the United States they want me to file I-824 in order for my case to be forwarded to NVC. And so I filed today I had a money order $465 each so had a total amount spent $930 to Dallas Texas Lockbox since that was the designated address according to my case. Does anyone experience the same as mine??? Give me an input or tell me anything your experienced. Thanks...

USCIS will automatic send the approve I-130 to NVC, so I really don't know why you have to file I-824. Just call USCIS and ask them why your I-130 not send to NVC yet. Also, be aware that the son under 21 will not be able to follow the mom since IR visa does not allow derivative.

What happened is I filled out both part in the form I-130 that states my mom is in the united states and will adjust a status and also same as my son but then I also filled out the part that they will apply a visa outside the united states...so might be a confusion for them on how to understand my application form.  

 

What do you mean by my son cannot follow the mom? My mom is my biological mother my son Iam the mom they are two different benificiary that I petitioned.

Um yep .. that’s the confusion. So which is it .. are they here and need to do AOS or are they overseas and going through the Consular processing. You need to sort this out with USCIS and get the petitions on the correct pathway   I do not know if the I 824 is the correct process. Have you spoken to a tier 2 operator at USCIS?

Let me clarify : you're the US citizen son file I-130 for your mom?  and your son ?

Two different petition with different category, so contact USCIS and find out what going on.

I did spoked to a Immigration Officer and this is what she told me to do to file I-824 form..and she said in my case it should not take long, if I follow what is on the approval noticed sent.

K. Then unfortunately the confusion created by the information on filing has cost you money but is not going to be more of a problem  than that.

Two different petition with different category. Your mom petition is IR category so the is no limit on the visa. However, you file second I-130 for the son over 21( your brother?), and the wait time is around 10-15 years.

I have a son in the Philippines he is 15yrs.old. 

And I have also my biological mother in Philippines.

Iam getting them an Immigrant Visa.

Thanks. This will be more easy to understand than your first post. You can try contact USCIS and request for Tier2 officer. They maybe busy, but it's possible to get a hold and talk with them first.

I did spoked to an Immigration officer and this is what she told me to do to follow what is on the Approval noticed sent. And in my case it should not be long to get it done she said. I just want to and post my experienced to let the other filers in the future to be aware of making a mistake in their form...because I didn't know it cost me money and now it is. Lesson learned.😢

Have you got the i824 approved yet??

Yes it was approved in days only this is for my mom, I submitted the I-824 Mar. 3, 2020 and the case sent to Department of State on Mar.6, 2020 but my son still pending until now they updated his April 1, 2020 but since then the case was not yet forwarded to The Department of State...don't know why. Just got lucky for mom's case.

How u got it approved in days??? My wife filed the i824 for me about 2 weeks ago but we havent got the letter from uscis that recieved it yet.

I had no idea either. My mom's case now is in Manila Philippines ready for schedule for interview. But my son's still pending it says on his status "Correspondence Received and USCIS is Reviewing it." Who knows what happened to my mom's case. It was a miracle I think.
