I filled my joint i751 on April 2018, in February 2019 got divorced and only communication were fingerprints in almost 3 years of time, so in January 2021 I decided to go Mandamus route after numerous tries to kick the case with congressman ombudsman etc...So once I filled mandamus in January 2021 I got interview set in February 2021 for March 16, attended it and was grilled for 1h45minutes, after it had a hard feeling that I am actually a human being, she told me at the end that she still needs some more time and that will inform via mail about the decision, my case tracker is stuck ever since in fingerprints done on July 22, 2019, bottom line feeling miserable after all this bs, plenty of proof, entered 100% my marriage in good faith, got cheated by ex wife and mutual friend at that time, she stayed pregnant that’s why we divorced...on top of all that misery they kept me another 2 years lingering in that past life, if I didn’t sue them who know when I would actually get moving, so was left with Mandamus as the only option and got grilled like I am a criminal

I am very sorry to hear that. Totally feel your pain. 

I was in the similar situation, filed joint I-751 on Mar 2019, got divorced on Oct 2019. I contacted congresswomen etc, spoken to 2nd tier officer every month. I missed interview on Mar 4 2021. rec‘d Denial letter on Mar 6 2021. I went in person to local Immigration office twice a week, submitted additional docs, affidavits, addressed to the supervisor. No one was willing to help me in the office. But I never gave up, until I speak to the supervisor on March 12, 2021. Supervisor reviewed my case, and got approved on the spot.  

 

My suggestion:

- Write a letter to your local Immigration office and explain your situation (how did you got married, how did your marriage ended) and attach w/ strongest supporting doc again (pics -indicate date and captions each photo from beginning to the end, marriage Certificate, divorce paper,  lease agreement, joint bank acct etc)

- Affidavits from mutual friends

I gave them all of that, plenty of proof, got my interview on march 16th and been told after 1h45min that she still needs some more time to go through documents...I don’t know yet I might get approved and might get denied, just was telling the grilling was terrible experience...don’t know how much should wait more, my case tracker is still stuck in fingerprints done on July 2019 lol, didn’t even change to interview scheduled, performed, etc so I am checking it now but don’t know should I even expect any change there

I gave them all that prior to the interview day also. I still got a denial. Instead of going thru motion to reopen, I am writing to the supervisor for reconsideration and reopen the case. I truly hope you won't need to do this.

 

I think your case will most likely to get approved. Seems like the officer just wanted to find something to deny your case but you are very confident abt your previous marriage. Or another possibility is that office did not study your case prior the interview.

I am thinking and trying to justify that long grilling, she was actually upset that she is getting right answers and the right dates even about events 3-4-5 years ago...either she questioned much because she didn’t have time to study the case or she was just vindictive because of Mandamus

I remembered when I got I-485 interview, I was also being told need more time to review the case, and I should be getting a decision within 1 week.

If your case isn't update online. I would give it 2 weeks for mail delivery. If you still didn't hear back from USCIS, I strongly suggest you to go in person. Ask to speak with supervisor for your case update and attach w/ docs above. 

 

All staffs told me to wait at home, check status online, bah.bah..bah..... You and I both know USCIS Online doesn't work. LOL

They are pressed by Mandamus case to give me the decision by mail, I just wonder will they wait last date possible to give the decision or will they even ask for 60 days more time...cause I really doubt they will actually expedite it and will rather let me lose my mind waiting

If you have good reason, you could ask them to expedite it. I know few ppl have done it and approved on the spot. Again, you have to speak w/ the supervisor. Where is your local immigration office?

Jacksonville field office, I mean I don’t plan any trip until that is done anyways, so no real reason to expedite it except the reason that they are dragging me since April 2018 with this petition, it’s ridiculous

Thanks for keeping everyone up to date on your case.

 

Could I ask, what city are you in, and how did you go about finding a lawyer who specializes in Mandamus? Also, how much did the Mandamus process cost?

Sensible. I am going through the exact same (although this is my second time).

USCIS does have power and discretion to reopen a proceeding or reconsider a decision, WITHOUT having to file an I-290B, which in addition to having very narrow set criteria also has a high cost and a long & unknown timescale.

 

 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.
