When I first crossed the US border in December at the airport and passed through CBP, I declared that my intentions were to travel and to visit friend from college, which was true, but I never mentioned I have wife in US. Only eventually in February me and my wife decided to opt for AOS through a lawyer. I was held at CPB office at the airport, anyway, for further information like how much money I had, why I have had crossed the border several times in 2019 etc.

Is there a chance that what I declared at the border would come up during the OAS interview? If so, I will tell the truth undoubtedly but can it affect my AOS application?

Hello , yes that could come up in your interview because your intent wasn’t only to see friends etc. always be honest with immigration. You should have mentioned your wife for sure , every time I visit the states I always make sure regardless of why I’m going to say My husband is there. Please rethink doing the AOS the likely hood of it being approved is slim because of your intentions. I’ve been to immigration lawyer friends , my parents lawyer , my husbands been to two over there and They said that many lawyers recommended doing AOS but what they don’t tell you is there can be repercussions in the future and complications with your Green Card interview , getting an SSN etc. your best option is return home and apply for CR-1. Hope this is helpful

Hello again folks! Sorry for the absence but I reached my maximum number of posts allowed per day. I would have like to reply before.

First of all, I want to share a locked topic to all of those who seem that want to put me in jail right now because they have solved the case:

I just hope moderators will read this.

It doesn't seem to me that there are a bunch of negative attitudes here from people here.   Most responses to the OP are just people being brutally honest.

Nothing about the OPs story passes the smell test.    Dude, I would hate to be you in a AOS interview.

Doing things the right way when it comes to US immigration is a long and arduous process.  Have a look at some of the treads of people who have been sent to the Nebraska Service Center trying to encourage each other during the long a silent wait for some kind of change in status for nearly a year or more.   It's going to be hard to find a sympathetic ear from most of us here who are doing it the right way when a person clearly is attempting to cut in line.

Good luck.

I feel for you on this one.  It sounds really stressful.

I just stumbled on your question.  I do not mean to pile on, but you definitely should listen to what others with real world experience say here.  Basically, read the room.  If you hear a lot of people who have been living with AOS nonstop for months on end in their real lives telling you something feels "off" about what you are saying, that's probably a great indication of what a customs agent might be thinking as well.  It's better to hear it here than elsewhere.

I think people (and maybe the customs agent who interviews you) are getting the feeling that it doesn't totally add up.  It feels to many here that you might be trying to find shortcuts and bend the rules. First you asked about a fake SSN to work?  That's super illegal and just not okay.  It shows you are looking for shortcuts.  That's the first problem.  And then you said the following which shows that you were considering which route to take while still in Italy:

"When we first had to decide which way to get, our lawyer told us that if I wanted ask for the GREEN CARD from Italy, so consular processing and not a AOS, it would have taken from 18 up to 24 months to be able to travel and work to US. ... That way, ok, I could still work in my country but at the same time could not see my wife for a long time."

If you decided from Italy to come to America as a tourist and then AOS based on your marriage, it means you were intending to stay here.  That's intent, and that's a problem.

Maybe they ask, maybe they don't.  Maybe they care, maybe they don't.

But, a whole bunch of people who are not paid to look for clues are seeing a whole lot of clues.

AOS sucks!  Not working sucks!  Being stuck in a country away from family sucks!  It's the trade off for this type of Green Card.

I have found this community to be amazing!  And part of the beauty of it is the honestly of the group.  It's better to hear potentially bad news here than from a customs agent sitting across from you.  It might not come up and you might be okay, but it's wise of you to really listen to the visceral / gut response people are having.  If an agent has that same spidey-sense, it could end really badly.  Smart to listen. Take it all in.  Value the opinions here and keep talking and reading and considering what to do.
