There's no such a thing interview waived its upto uscis discretion but you can't ask for it from your side

But on their website they have a list of reasons why they can waive the interview, and it's like "you may lose the scholarship" or "you need emergency medical care". How would they know if I am in any of these situations? Sounds like you can let them know that you are. I know its probably not something that will work out, but I thought it's worth checking out

Good to have you here.😊 Although each case is different you need to prove you had a qualifying relationship with your spouse, shared residence, good faith marriage, good moral character and that you were indeed a victim of abuse! Fortunately everyone here is very helpful so you're in the right place. Do you have any specific question? I advice you start gathering documents to support your petition..also it helps to read earlier threads so you can have a grasp of all it entails.👍

I just saw in the news that USCIS will suspend the emission of Green Cards for two months.

 

"The order would apply to foreigners seeking employment-based green cards and relatives of green card holders who are not citizens. But Americans who wish to bring immediate family to the country would still be able to do so, according to the official, who spoke on condition of anonymity before the plan was announced''

@stillwinning I got married Feb of 2019, but I knew him since 2015. I became a victim of abuse since we moved in our his new house. We were scheduled for the interview Feb 27 2020, but he withdrawn the petition, never had the chance to have a green card. Now, I have supporting documents of my marriage in good faith, one of the very important  evidences is the witness of abuse. I only have one witness to the abuse. My 19 year old son also witness the abuse made by my husband. Now, one witness is not strong enough to win a vawa case, can my son be a witness too? Since I am not an extrovert person, My only witness is our pastor.

Thank you for clarifying. I feel bad for the sudden changes for the affected people and their families :( and somewhat relieved for us!

Would this mean Vawa applicants are not effected? Are we still considered immediate family even though we self-petition? So worried.

You can prove abuse by providing either police report or medical report, psychological evaluation and through the statements of witnesses. So you might want to gather all you can. You don't have to have all I've listed but anything you're able to provide will do. Start attending therapy as it will help you heal! You need to start from there..the evaluation report will help your case too. Anyone who witnessed the abuse can testify. Take note of all the evidences I stated earlier to prove you qualify for this petition. Get your marriage certificate, mails in both or either of your names to the shared residence, bills, insurance, bank statements, etc to show you lived and had a life together..good moral character..this can include a personal statement from you, statements from friends, family, neighbours..in your case your pastor can write. Isn't there a chance a neighbor or two..and even perhaps the landlord knows something? They can write too..he didn't just marry you out of thin air..wasn't there any witness? A friend or two? They can write about good faith marriage..you need to prepare carefully or else you'll be faced with RFEs which can delay your case. If you go through earlier threads, you'll have fewer to no questions. Whatever I have written or will write in response has all been addressed!👍

I see, I am going to wait one more month so that the 6 month period is over and perhaps then contact them and ask for help.

I do hope the new executive order does't effect our cases.

The only update on my case status has been " Name updated since January 6. Today the I360 case status changed to we have received  ur correspondence  and we are looking at it. I ve not received any RFE and not any correspondence sent. I am confused here. Is it that the status change because they are processing  my EAD or what could brought such update. Kindly help me shed lights. I ve been without Job since December  and it is really becoming  frustrating.  Thanks all.

Hello. Try to renew in a timely manner next time..it helps. With USCIS one has to be patient. You can also enlist the help of your representative to enquire on your behalf. Those updates are no cause for alarm..a lot of people here get them.. I did too! I recommend you enquire through your rep.👍

Hey guys, I am applying to renew EAD+AP this week. It's a second time I am doing this but I dont remember if I need to include something to get fees waived or it is automatically waived if I have I485 pending, right? Thank you!

Also, another question regarding filing taxes. So I filed as non resident alien. But when we were discussing stimulus check here I found out that we are resident aliens even tho I485 is not approved yet. So, I131 (AP) instructions says something about filing taxes as non resident alien might be a reason for inadmissibility. Do you guys know anything about this?
