Dear all thank you to look at my problem I applied for a i360 without applying for a i485 I had a i130 and i485 pending which was cancelled and my EAD renewal was denied but my lawyer refuse to apply for i485 saying they will deny it while my wife is us citizen I don t know what to do should I stay and wait as he say as I am only on my 10th month with prima facie I don't know what to do as I see I will still spend a lot more time waiting and not sure . He tell me it will bring more complication on the process

Yes you should apply for your I 485 now. You can get EAD C09/AP before your VAWA is approved.

I would say to you to talk with your lawyer and let he/she knows that you wanna file the I 485. There is no complication for doing that now. If he doesn't want to file the I485 for you, you could do it yourself and write a letter to Vermont letting them know that you don't wish to continue with you current lawyer's service anymore, and if you are using his office's address, you will need to update it sending another letter and the Form AR-11 to Vermont. To folllow with your case is always better to contact your local congressman. They help a lot more than any lawyer.

Can you please advise me do vawa petitioner pay for the extension of there EAD, i mean i think that my lawyer is messing up and again they are asking for a filing fee??? Could it be that if my VAWA application is approved. or if it just a fee waiver that has to be filed addition to the request for the extension of the EAD?

If you have a c31 EAD (check on your EAD card if you are not sure), but c31 EAD is the one issued based on approved 360. For that category yes you do have to pay for a renewal (or qualify for a fee waiver). 

 

If you have a c09 EAD - thats the one based on having a pending 485. Then if you paid the fees for the 485 - the initial EAD and subsequent renewals of it are free. If you used a fee waiver for the 485 then you need to send another fee waiver for the EAD renewal now or you can pay for it. 

 

Your attny may also be charging a fee for their services to send the renewal. You can ask if you could submit it yourself to save money.

it is under c09 and idk all my EAD were free of charge and i cant afford to pay it im not working right now that's why i was worried and wanted to see whats happening why is that change.
