Background: I knew my spouse for 8years and we dated for 2years and engaged for 1 year before we got married. I only came to visit him in the US on a B1/B2 when he convinced me to stay. I had a great carrier in my home country and i only found out I was supposed to be his meal ticket (given IT is a big deal in the US). I had already ruined things back home cause I left without saying goodbye to anyone including work. He got extremely violent when he found out how long it will take to get me my EAD or any immigration document, cause he was hoping I'd work and make 6figures so he can sit around and spend my money. He turned me into his punching bag after having too much to drink. 

Please find my timeliness below:

 

Filed my vawa Nov 2016, was married to LPR who's in the military and became extremely abusive.  

Got approved Nov 2018

Didn't get the i360 approval notice until March 2019

Got First EAD April 2019,

Second EAD January 2020

 

Filed i485 April0 2019

RFE (birth certificate) notice June 2019 and responded and received notice July 2019. I have not heard from USCIS since then. It's been almost a year now. And it's been 15months since I applied. 

 

Questions:

1. Is anyone else in this situation with the delayed i485?

 

2. While applying for my next EAD, is it safe for me to also apply for advanced parole and travel out of the country briefly? I'm asking cause I overstayed my visa by 1year before any application was made to USCIS. 

 

3. Do you think I should schedule InfoPath or call USCIS to request info on my case?

 

4. I have a great job now using my EAD cause I have a BSc and MSc in IT and doing extremely well in my field. Do you think it will be a good criteria at the interview to get my greencard?

 

Any advice will be great appreciated. Sorry for the long read

Hi. Your i485 is not unusual at all..there are folks here waiting since forever...this however doesn't make it normal..you are welcome to enlist the help of your representative to enquire about your case. Yes you can apply for advanced parole and can travel when it's safe to do so considering the times now. You can schedule infopass soon as they are open to the public..not sure about the current situation. Lastly your impressive job definitely makes you look good..puts you in a good light..it's valuable to the economy..but if you have admissibility issues it may not help with the process. If you do not have any such concerns, no criminal charges etc..then you have absolutely nothing to worry about!😊👍

I have a completely clean slate, no admissibility issues or criminal charges. I just want to get things over with soon. Another concern is I ran to a different state and don't know where he lives, so don't know where to send my divorce papers when I file. So I'm not divorced yet, and my immigration lawyer wants me to get the divorce process started soon. Don't know what to do...

Please know that you do not have to be divorced to win a VAWA case. I had my Greencard while still married to my spouse. Your lawyer should be concerned on gathering your evidence and filing a strong case for you..divorce isn't the first thing..for most, it comes later..or last! It's best you're far away from your abuser! Your lawyer should be able to handle that part...the divorce attorney..that is!👍

Wait time for interview should be the same as new I485 but these days it is taking longer time than usual.

I suggest you contact your congressperson to inquire on your behalf, because USCIS is messy to update the address.

It depends what State you live, some States the person must wait  14/16 months to have the AOS interview, other States 4/10 months.

 

Yes it's safe to travel abroad with Advance parole, but there are  some Countries have restrictions to reenter here because of the Coronavirus.

 

USCIS will approve your AOS   if you had a  bonafide marriage, nothing else.

I just received my I-360 approval notice and deferred action with it as well. Was waiting for around 11 days since the system updated online. 
Hope the interview will come soon enough!

is it safe to drive through a border patrol checkpoint station in Texas or New Mexico? (not the ones at the border). I'm not going to Mexico, just driving from New Mexico to Texas. I read there are also many checkpoints far from the borderline in those states. I'm still waiting for vawa approval but I have my work permit. would i need to carry that with me? can I get in trouble for driving through one of those stations?
