so know I should file another one without my abusive spouse?

Correct, file a new I-485. As a VAWA self-petitioner you don't need to submit I-864 or I-944:Β https://www.uscis.gov/system/files_force/files/form/i-485instr-pc.pdfΒ Page 14

Some old guides mention I-864W; I-864W is now obsolete. Ask someone that has filed recently what they selected for Public Charge questions on Page 14:Β https://www.uscis.gov/system/files_force/files/form/i-485-pc.pdf

I thought i have to be I-360 approved first in order to apply for AOS while married with Permanent resident?

Also see I-485 instructions:Β https://www.uscis.gov/system/files_force/files/form/i-485instr-pc.pdfΒ Page 24

"If a visa is immediately available, applicants filing as VAWA self-petitioners do not have to wait until Form I-360 isΒ approved to file Form I-485. If a visa is immediately available, you may file your Form I-485 together with your FormΒ I-360, while your Form I-360 is pending, or after your Form I-360 is approved."

were you spouse US citizen?

Note that F2A is Current at the moment. So currently, those that were abused or battered by their LPR spouse also qualify to submit I-485 concurrently with or while I-360 is pending.

Thank you so much, I will file it today. Last question, I filedΒ an I-485 when I married my abusive spouse and that one was canceled,Β right?Β so know I should file another one without my abusive spouse?

Β

thank you

Not necessarily, if you haven't received Final Denial notice then you can send a letter to USCIS with photocopy of I360 receipt asking to switch your I485 from marriage-based to VAWA-based. Not entirely sure which office you would send it to though, I'm guessing local and they transfer it to VSC then? Better ask someone else about that.

No, I paid the fee. Still nothing on the 485.Β
Β

why were they rejected?

Used an old form first time, then they denied myΒ  waiver. If it is more than 30 days, give them a call.Β

Hi everyone, I have aΒ question , it mightΒ beΒ silly but...Β I have receivedΒ myΒ prima facie, does it meanΒ that I can stay in usa legally while waiting a responde from my i-360?Β I’m asking because I live in san diego and there areΒ a lot of border patrol here, just dont wanna beΒ in any trouble. Tks

as far as you have pending case with USCIS, you are legalize in this country. Make sure to carry your immigration documents with you in case of border patrol investigationΒ

My I-485 filed with my abusive spouse was denied because she kicked me out of the house andΒ didnt give my letters soΒ I couldnt respond uscis on time. Was terribleΒ when I got the denial.

Yes you're right I360 approval first before 485 but in my situation it was the opposite, 485 interview before 360 approval. There's no interview for the 360 just one for the 485. You might be the lucky one to have both approvals with no interview πŸ˜ŠπŸ™πŸ»πŸ™πŸ»πŸ™πŸ»

so how did the I485 interview go ? was you rejected or asked to put on hold until I360 is approved ? Did they put on hold ?

Hi All,

Β

Finally after 310 days and after multiple calls to uscis and contact congressman and ombudsman, my I-765 under C09 was approved. At least I won't be stress for a while until my vawa case is processed.

Β

ThanksΒ God.

@sandranj

 @Stillwinning!!!😊

Guys i need help. My i-131 is pending since july 10th. Originally it was sent to NBC. and today i called to USCIS inquire about it. The agent told me he does not have access to my file. Therefore, i need to write to Vermont service center.Β  My question is,

Β

Why do i need to write to Vermont since it was originally sent to NBC?

and What should i write to them? if there is any template?Β

Β

Thanks in advance.Β

Nope none of that happened. We surely did finish the interview ( it wasn't an easy interview in my case, we went thru everything from beginning to the end) and she handed me a sheet of paper with indicated that I'll have an update within 120 days from the day of the interview. I got a notification saying that my interview was completed and case must be reviewed.

Hoping and praying πŸ™ all goes well.

VSC is in charge of i360 petitions and petitioners..this means all other petitions will go through Vermont...the very reason you need to write them and not NBC. There's no formal template, just write to Vermont enquiring about what the delay is about...also you can enquire through your representative. In my case my attorney erroneously sent my i765 to NBC after what seemed like forever..NBC transferred it to VSC..2-3weeks later, it was approved. I'm sure the delay is because of the wrong destination..but not to worry it will be transferred accordingly.πŸ‘
