You can send i485 with your i360 as well even if your spouse is GC holder because visa dates are current. The advantage is you will get c09 ead otherwise you have to wait for work permit

When i went to a lawyer she told me same thing to wait but i needed a work permit to work. good thing i joined this forum and i learned you can apply for i-485 and i-765 if your spouse is USC. I then did file i-765 and got my work almost a month ago. 

What i learned from this forum is that most of those lawyers out there do not know much about VAWA. 

You got your work permit C31 without I360 approval ?!

I'll wait until end of June,  f nothing happens I will definitely request help from my congressman.

It's also possible that it's been moved...they don't always update! Best to find out through your representative.👍

If you were married to a Legal Permanent resident, then, you usually have to wait for a visa number to become currently available to you before you can file (I dont know exactly how that works). Some one else will help you answer that. 

 

Thank you! I'll send my I-485 paperwork next week then. I'm still legally married, I was waiting for this letter to start to divorce proceedings even though my lawyer said that I could divorce already. Let's see what happens. Thank you!

I485 enables you to apply for i765, not the other way round. It's always advisable to make research..better than swallowing everything thrown at you. It will help tremendously to go through earlier threads...I notice that folks can't be bothered..it really does help broaden your understanding of how this entire petition and immigration system works.👍

More people need to know aboit this option.

The hardest part in waiting for vawa to be approved, is not being able to work. 

18minths since i have filed. I don't have a work permit.

I made the same mistake because i didn't do more research. I believed my lawyer who didn't know about this visa bulletin thing. Here I am 18 months waiting..no work permit.

@balo101   pls how long did it take you to get your work permit. Was also in the same shoe. Lawyer told me that I cannot get work permit till after my vawa is approved. Was starving till I came across this forum. God bless this beautiful forum and everyone out here. How long did it take you to get your work permit ? cos i just filed mine after I had applied for my i-360 since last year

I live in Dallas.. i contacted Senator John Cornyn office and they responded me with the answer within 2 weeks

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
