My tax preparer from HR Block asked me if my abuser lived with me in the last 6months I said no, then he filed it as single as usual for the tax year of 2017 and 2018 now the 2019 current one..I took my previous tax documents all single status to the interview where I was approved! I asked about why he filed single..he said that's how it's done tax wise..so it must be really how's done..seeing this right here.πŸ‘

The same thing happened with me. I was living separately with my wife for more than a year when i filed my 2019 tax return. My accountant filed it as a single as well

Hi everyone!Β
Happy International Woman's Day!
Guys I got the followingΒ email from my ex yesterday:

I am sorry for what I did to you and to your family. I’m sorry for hurting you and just leaving you in the dust. With no where to go and very little options. I understand how that must have felt and I was incredibly insensitive towards you. You didn’t deserve it. I know you may never forgive me but I want you to know I am truly sorry.
If you need help, I can help you. As a friend and nothing more. I know things might be tough right now.

So, I am thinking that such an email might be an additional proof because if person is sorry it means that person feels guilty and so it means they did something..
What do you think? Should I send it to USCIS as an additional proof ?
Thank you!

Β

This is how I won the process with my abuser he denied everything at courtΒ

but on the phone when we was talking he confirmed that he recognized that he hurt so the official listen to the phone call and find him guiltyΒ

So it must really be the guide as stated in that IRS document dreamer posted! I was really worried about the single status filing..but the HR Block staff explained that is how it's done. Still I was skeptical about it..especially for the interview but turns out it's nothing to worry about!πŸ˜ŠπŸ‘

Perfect, now I have more confidence seeing that @Stillwinning!!!😊 and @Shroy123 also had same experience. Thanks 😊

Β

also, let’s be more cautious of using language like β€œfraud” so lightly. We are all battling a lot of mental health issues connected to this ordeal, let’s think about if our words may trigger someone.Β

I believe you can always amend your taxes in 3 years block. There are some people here who are abused but still live with their abusive spouses.

Yea... I can’t imagine what that would be like. I am so lucky to have support!Β

Hello everyone! I'm happy to see approvals!

I want to request to expedite my Advance Parole to travel. How do I go about this? Thanks in advance

I've never done this before..but I think you have to get proof of the emergency you are going to attend to..then they will decide if it's serious enough to expedite or not. Also you can schedule an infopass talk to an officer..like I said if it's serious enough, your request will be granted. Still wait for the opinionΒ of folks who've actually gone through it successfully.πŸ‘

Dude, I dunno. I trust this accountant. As always, everyone should do their due diligence before blindly following anyone’s advise who is not a professionalΒ

First of all, I am not a dude.

Β

My information is from my own personal experience at my local IRS office when my husband was filing joint taxes and owed back taxes that I was not aware of. Β I had to pay the back taxes, I was filing single as well, IRS officer informed me that I could not as we were still married. Β I could only file married separate or head of household. Β If the IRS audits you as single, it is considered fraud as single have different tax credits than married.

If you are concerned about your tax filing status, then you need to get divorced. Β Your spouse, if they know your SSN can still file married jointly, and there is a turbulent process to disprove your spouse. Β IRS requires that they are informed that you are disputing the taxes that were filed. Β

Β

USCIS has no say so over your tax filing status, they don’t care what u file.

No RFE , No prima facie

@Hritik RohailΒ y'all gon hear soon. At 18months..I was expecting to hear from them..Then I did. RFE!(a little set back)..it just delays you. @TounaΒ I believe you can request prima facie if you intend to use the benefits..prima facie doesn't mean your case will be approved, but it's nice to have. Sometimes you just go through the whole process without RFE..pray you don't get any..because like I said, it just delays the process! Praying for y'allπŸ™πŸ˜ŠπŸ’

Hi folks, am filing my i-485. I was married to my abusive husband and my work permit ran from Jan 2018 to Dec 2018. But he abandoned meΒ  January 2019 and never showed up for interview. My case was abandoned. Finally, we got divorced but I was still working with it in the office where I worked cos I have no other means of survival. They finally stopped me working on march 2019. I applied for vawa July 2019 and got RFE on SeptemberΒ  2019 which I responded Jan 20120. Now I am filing-485 and I got to the questionΒ Β of "have you worked unauthorized".Β

Β

Secondly, A question says have you been in removal proceedings ? I dunno what it means ...I didn't show up for my interview because my abusive husband got the letter on the mail and tore it before abandoning me, unknown to me I have been called for an interview only to receive a 30 days notice to leave the country. So is that a removal proceeding ?

Β

I don't know what to put because if I say yes, will they deny my application or if I say no will they find out later. Please friends help me with an answer @sandranj@Stillwinning!!!😊.

Β

God bless you all wonderful people.

Well what's done is done..the i485 was alreadyΒ viewed as abandoned and denied..usually when this happens, removal proceedings is inevitable. You just have to answer truthfully, I understand that prior unauthorized work is forgiven for VAWA petitioners..not sure 100% about the implication of the removal proceedings..Sandra will throw more light on that as the attorney here. But you're better off answering truthfully.πŸ‘

Thank you dear @Stillwinning!!!😊...I will fill in that, hopefully Sandra can throw more light on what is removal proceeding. I have no Idea

Oh I know what that is..just don't know the implication on your current intending petition (i485).Β So basically you are issued a notice to appear NTA which is presented to an immigration judge who determines if you are removed from the U.S. or not.πŸ‘
