That was about 4-5 years ago.  Now it is anywhere between 1 1/2 - 2 years.  Some are 3 years

Phase I - IV - Completed the Immigration Journey

Hello everyone

can I nenew my EAD (category c9) without my vawa receipt notice  . I haven’t gotten the vawa receipt yet but I have a pending I-485 and my current EAD will expire in 2months so can I go ahead and submit the nenewal without the I-360 receipt .

Be reminded that if you filed for VAWA, the documents should be sent to Vermont not NBC! You can send in what you have which is what is needed anyways..the i485 NOA! You're sending in the renewal a bit late... Should have been at least 180days prior to expiration..but hey better late than never!👍

Thank you so much

Yes it’s Vawa and it’s getting late , I kept holding on because I thought the I-360 NOA was very important for my EAD renewal and I haven’t gotten it yet. So I’ll just send it to Vermont with the i-485 NOA

You're welcome. Also you might want to include a cover letter reiterating that you filed VAWA and yet to receive NOA! It would serve as both a reminder and informative as well, so they know why its directed to VSC!👍

Vawa approval notice after ead c31 usually get it within 3 months..

I really pray it doesn’t take that long because unlike most people here who filed concurrently. I need that approval notice to file my aos and they took 2 years to approve my Vawa, I had to get my congressman and ombudsman to help. I hope I don’t have to wait too long for the approval notice

We appreciate you plenty incase we don't say it enough!

"Why, thank you, Dear," he responded politely.

No need to say anything when upvotes are handy to allocate. :P

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Although I got mine about a month of approval but the pattern has changed, based on the experience of folks here..it can take anywhere from 30days-90days like @Shroy123 mentioned as well...You can request it for sure..I've seen few people do and got response. Just that it's kinda still early for you..probably some administrative processing still going on..you'll surely get it.👍

Thank you. I wait a little bit more.  I hope I don’t have to wait for 90 days though because it’s whats holding me back from filling for my aos. I don’t have the privilege of having my I 485 being transferred to my local office after my Vawa approval so I can’t move forward with my AOS journey without the notice.

You can't help it if you have to wait that long..it's really one step at a time in this matter. Also your AOS petition goes to Vermont..they will transfer accordingly! Above all I pray you get it quickly as I totally understand your anxiety! You can ask your representative to enquire on your behalf as sometimes doing so, helps to set things in motion!☺👍

. So these 2 things: will paying his legal fees and having prenup be a red flag like you said as like marriage being a fraud and stuff (which is absolutely not right as it’s him just used me and abused me) to USCIS? I was too stupid to believe him.

Nothing unusual about having a prenup or paying his legal fees as you explained it.

i think yesterday my attorney told me that I just got I-360’s “card being processed” update as it means I will get c31 ead soon. Attorney did send the divorce degree right after the divorce was finished like 1.5 months ago and I had an RFE from USCIS at that time. And so we included it with this RFE response.

You do not need to be divorced for VAWA. They will want your divorce decree if you are divorced though so its good that you sent it. Bring a copy of it to the interview just in case it didnt make it into your file. The 'card being produced' message means your 360 was approved! CONGRATS! Now you just have to wait for the 485 to be scheduled for interview at the local office. VSC will send your case to NBC and NBC to local office. You may get a courtesy letter about the transfer, you may not. You may also get a notice to update your medical at some point.

At the 485 interview they are not suppose to ask about the abuse. VSC approved your 360 so its been decided already that you qualify as a victim of abuse. The 485 interview is usually very quick where they just review the 485 application and confirm stuff. They just need to make sure you are eligible to adjust status.

Why do they ask info of residence? Is it for in-state tuition? Is it for financial aid? If for financial aid, you qualify to submit FAFSA form if you have "Prima Facie" letter or if I-360 is approved: https://studentaid.gov/understand-aid/eligibility/requirements/non-us-citizens
