I visited uscis office through infopass and asked them.. the representative told me i can work because i am eligible to get 180 days extension based on c09 which gives automatic extension.

well that’s confusion because i didnt even submit my renewal my attorney did that for me.. and yes i worked on 180 days extension as well., however i had to laid off for 1 month because my 180 days expired as well.

i posted my situation here in this forum as well for guidance because i was confused too

Wow very similar with mine only thing I am not sure our HR will let me work under 180 extension looking at my receipt notice being CLASS REQUESTESD:C31. But I still have 4 days to go before original EAd will expire I will hurry up file the c09 renewal.  My follow up question is do I have to pay fee for this c09 renewal? If not, what documents should I attach so I won't have to pay fee.  Thank you

No you dont need to pay fees.. c09 is free for renewal and just do it..

A photocopy of the receipt notice of the pending I-485. When you send it make sure you use the fastest delivery option available.

 

8 CFR 103.2(a)(7): "Benefit requests submitted. (i) USCIS will consider a benefit request received and will record the receipt date as of the actual date of receipt at the location designated for filing such benefit request whether electronically or in paper format."

If you can afford to pay the fees, I will say just do it. I sent my renewal on 04/10/2020 with the I-912 fee waiver, bank statements and other documents to proof I could not afford the fee. I have a pending I-485 so my renewal should have been free even if I didn't send the fee waiver. Long story short, they returned my application and requested the fee. I had to resend my application with fees before they accepted it.

Oh wow this gets more confusing, USCIS isn't consistent :( what is the status of your renewal application now?

I sent my initial renewal application on 4/10/2020. USCIS received it on 4/14/2020. They sent the application back requesting that I include the fee on 4/29/2020. I resent the renewal with a check for the fee on 5/4/2020 and it got delivered 5/5/2020. USCIS took the money out of my account on 5/20/2020. I haven't heard anything from them yet. I included the G-1145 form so they could notify me when they accept the application but they haven't yet even though the check has been withdrawn.

C09 is free.. you dont even need to attach fee waiver. Just copy of pending i485 is required..

Sandra advised that I include that because USCIS was denying renewals without a fee even though renewals for C09 are suppose to be free with a pending I-485. 

 

Yes, I did include a copy of my I-485 receipt

Yes, I sent a copy of my pending I-485 receipt but they still returned my application. 

 

 

It was confusion because you attached fee waiver. C09 is usually free
