My I485 is not based on marriage, he never filed for me..

Here is my timeline

(AUGUST 2017 FILER)

I360 approval : June 2019

I360 approval notice: June 2019

Card mailed (c31): July 2019

I485 filed : Sep 2019

Medical : Oct 2019

Case transfer notice NBC:  Dec 2019

Biometric : Feb 2020

I485 rfe(birth cert) : Feb 2020

I485Rfe response :April 2020

I765 approval :May 2020

Card mailed : May 2020

 

I don't know if I485 is approved or not. Just curious!

Vermont approves your 360. It then goes to the NBC where they do a pre screening. You may or may not get a 797 transfer notice. NBC checks that you have fingerprints on file, a valid medical, and proper birth certificate.. Ideally they want everything to be complete before they send it to the local office where you will sit and wait for an interview slot to open. Again you may or may not get transfer notices. Its common for people to get a courtesy letter advising them to have a current medical for their upcoming interview which will be scheduled- but no date is provided for when that interview will be. It can take a few weeks for Vermont to send to NBC and then NBC to send it to local office. So give it some time. If you dont hear anything (no transfer notices and no updates to online status) you can use your representative to inquire on it. Try not to obsess about it but dont ignore it completely. People have reported on here that they ignored it and somehow it got stuck somewhere and only started moving again when they had inquired about it. Glitches can happen.

Well missing from your list is when you filed the 765. Im assuming you filed it with the 485 in Sept 19 under c09 category.  Regardless a c09 EAD petition will be processed independently. In order to be approved you need a valid pending 485. If the 485 is approved you have a greencard so you dont get an EAD. Does that make sense?  It also seems you have 2 EADs now right? A c31 issued July 19 and a c09 issued May 20.  The c09 one is preferable to have because you need to pay for the c31 renewal (or use a fee waiver) and its likely that they would deny your renewal for it as you have a valid c09 one. The c09 renewal will be free as long as you paid for the 485. If you used a fee waiver for the 485 you then have to pay for the renewal or use a fee waiver again.  All this information can be found in the instructions for the 765. Now you can send the c31 back to Vermont advising them you have a c09 one now but its not mandatory. You only need one EAD. Just make sure you keep organized because its easy to get confused in the overall process.

All you can do is periodically check in like you have been to make sure the background check didnt come back and is just sitting there waiting to be worked on cause they forgot about it. Its rare for cases to be misplaced and therefore not being worked on but it does happen. The background check system can be very slow. They still use paper files that are shipped back and forth across the country as needed. If you have a common name or are from an area where information is not shared freely it can take longer. They look for anything with your name as its spelled, variations of your name and the phonetic pronunciation of your name. And they look at everything- stuff where the file is about that name and even stuff where the name is just mentioned in it.  So somewhere someone is sorting through paperwork looking to see if the "ranran27" mentioned in it is you. Perhaps there is one box with a file they need but right now its in Texas and then its going to go to Florida and then a few more stops before the person working on your case gets it. Its a slow process and as I said it cant be sped up.

Thank you @Villanelle. Now I understand better. Yes,the 765 was filed along with 485 in Sept 2019.The journey has been rough, but getting there gradually.. That was so informative and educative, I appreciate. God bless

I got an official I360 approval letter in March 2020

 

After these, I haven’t heard anything. Should I contact someone to follow up or do you guys think I should wait more? I don’t know if my file is in Vermont or NBC or local office...

Hi everyone,

                      How do I check the priority date on the I-485 application based on Vawa? I filed in August 2017 and it’s been over 2 years and 9 months since i field for I-360/I-765/I-485 applications. I-360 was approved in March 2019 and have work permit too. But, my I-485 application was reopened after an erroneous denial. Should I express my concerns to my Congressman or Senator? I’ve not been able to get any info from my immigration attorney. Her response is I should get it within 6 months. But, my timeline is really off, right? Please share your thoughts and I would love to hear input from

others about what’s considered within vs. outside normal processing times. Thank you. 🙏
