K1 waiting for EAP/AP/Green Card, I am from UK, married October last year

Went with my husband (US Citizen) to file taxes, advised to file married jointly, she had not dealt with a K1 previously. I have been asked to provide last 2 years P60 (UK version of W2), last 12 months payslips and Pension statement (do not receive pension payments for another 8 years. Does tis sound right ? I don't have any of the information they asked for to hand so will have to try and get it sent from UK.

It is not required by the IRS to send in any documentation of your UK income so she is asking for her own benefit. (And I guess to make sure you are being honest with her). The IRS has no way of knowing what you earned.

You can access your pay online. You’ll have to get two different tax years because of the April to April UK year so you can find what you earned Jan-April, then April-Sept (or whenever you quit work) to cover 2019 dates. I will find the link for you.

Make sure she knows you are eligible for the Foreign Earned Income Exclusion based on bonafide residence in the U.K., and that you must include a statement electing to be treated as a resident alien of the US for tax purposes.

yes, the website is a nightmare to get through at times.

Go to Account Home > PAYE > Check previous tax years > Check the income details sent to us

I don’t think you have to get pay stubs. The online info should be sufficient to show your income.

She wants the pension info to see if you need to file a FBAR or FATCA. (You can google those). If you only have a state pension, those don’t count. If you have a private pension then you report IF:

On FBAR (if over $10k value in US dollars)

On FATCA (over $100k value in US dollars)

I tried really hard to get a value of my private pensions to no avail. And mine exceed 30 years worth.  The IRS says if you have no way of knowing the value, you can enter a value of $0.  So I have submitted my pension fund admin name, address, etc, account number, and a value of $0 for the last 8 or so years. No questions from the IRS. They know I have pensions and where and that I have no US taxable distributions from them. The IRS just wants to catch people hiding taxable money abroad.
