They keep telling me when I call USCIS that they review cases according to the dates on their website. So for example today, I-765 at NBC they are processing February 9 filers. So it won't matter when you've done your biometrics during that period.

The Feb 9 date on their website actually means that 93% of the people with a received date before Feb 9 has been processed. If your received date is before this date, you can a case inquiry. 

 

"We now show case processing times as a range. The first number is the time it takes to complete 50% of cases (the median). The second number is the time it takes to complete 93% of cases."
"We have posted a “Receipt date for a case inquiry” to show when you can inquire about your case. The “Receipt date for a case inquiry” is the upper end of the range (converted to a date). If your receipt date is before the “Receipt date for a case inquiry”, you can submit an “outside normal processing time” service request online."

This means that ~50% of the people with a received date before April 9 should have gotten their I-765 processed by now, and all March filers can expect their I-765 to be processed soon.

Concurrent I-485/I-130/I-765/I-131 Filing (married to USC spouse):

2/23/2020: Sent in application via FedEx (following rules before new Public Charge rule) 

2/25/2020: Arrived in Chicago, IL
3/13/2020: Packaged received in return and rejected due to "outdated forms"
3/24/2020: Refiled application with new forms including I-944
3/25/2020: Arrived in Chicago, IL (received by Harper)

4/13/2020: Received 4 late-night texts with case numbers
4/14/2020: Application fee withdrawn from my bank account

4/17/2020: Received hard copies of Receipt NOAs (I-797Cs)
4/17/2020: Requested EAD expedite
4/20/2020: EAD expedite request denied: Case in "in suspense or on hold until we receive your biometrics" +  did not provide evidence of "extreme emergent need"

Except what good does it do to get it approved if we don't get our cards because they don't have biometrics

Not much. Expect that you become a class member of the ongoing class-action lawsuit against USCIS regarding the EAD printing delays. Also, as soon as you get your biometrics done, your card should go into the production line. 

Maybe you can use your approved EAD status, your old biometric notice, and some print outs of the court decisions in the class-action lawsuit to convince your local ASC to allow you to a walk-in biometrics?? Combine that with a financial loss argument, and I believe you have a very strong case!

I guess we could try that. Almost sure it will not work because security guards have strict orders.

February filer here whose package was returned due to outdated forms and ended up filing in March.

Talked to four different representatives using Emma chat since yesterday and got different information from each regarding my biometrics appointment. I had the same question for all four.

 

My Question: Could you please verify in your system if my biometrics appointment is scheduled?

 

5/8: Rep 1 - "You have to wait for ASC to schedule one for you". He said he doesn't have any other information.

 

5/8: Rep 2 (30 mins after I talked to Rep 1) - "You have appointment on 08/21 2 PM at San Jose ASC". He gave this info, then pasted a template message and closed the chat. Guess he just wanted to give the info and be done with it.

 

5/9: Rep 3 - "You were placed in queue for appointment scheduling on 7/31and you will get notice when it is scheduled. System doesn't show anything else".

 

5/9: Rep 4 (30 mins after talking to Rep 3) - "Your appointment is scheduled on 7/31 and you will receive a notice". He had no access to see the appointment date or if notice is mailed out.

 

All I infer is some scheduling happened on 7/31 and I am happy that I can expect appointment notice soon. But I'm frustrated by the discrepancy in level of information given by these representatives and the information they have access to.

Hey y’all! 
 

I had my biometrics today. Went smooth. Had some people in front of me that didn’t speak English so that took forever lol. I also just received an update on my case for I485 and I765 to following; Case was updated to show fingerprints were taken. Nothing major probably but nice to see they update since sometimes they don’t lol.

 

hopefully get my work authorization card soon so I can get my drivers license in Kansas. According to them it’s not possible without that or a green card ☹️

I'm a bit nervous as I had biometrics taken on Wednesday (May filer) and still no updates to any of my cases... I have read they don't always (or sometimes ever) update cases with this status, but it's still a bit worrisome.

i'm sure you will be fine, to be honest i wasn't expecting any updates as the biometrics appointment letter came without any update. I know a lot of people on VJ are still stuck on case received and have green cards in hand..
