I specifically asked this question earlier in the thread when I got rejected the first time - people are being accepted without filling in that table.  The instructions definitely make it clear it is optional by the use of the word "if" and "you may" and then saying to put this info in question 9 - but I agree if you list bank account information in the table you need the statements to back it up.  I left the table blank (I know at least one other person that did and did not have a problem) but since I am not leaving any blanks this time I think I am going to just write N/A there.

Fair enough. I guess we just wanted to show everything we could that would support the totality of our situation, and that we had funds and that we could support each other. So we just front loaded it with everything we could, lol

Sorry to hear about the rejection! That sucks! And those editions seems to be up-to-date... Are they reducing case load by giving out rejections?? 

I'm worried I'll get another rejection too now. No texts when you get a rejection, and other people who filed around the same time seem to have gotten their text already (arrived in Chicago 3/25). Fingers crossed!

For the supporting evidence for the 944 and 864, did you lump the 2 together or supply the evidence for both separately?

I am on the fence about the bank statements.  I am not listing bank account information as I am 250% over the poverty guideline on salary alone, so I didn't want to muddy the waters. 

My strategy with the I-944 was that it is better to give them all the information that you have, and not create the perception that you are "hiding" anything. Remember, the idea of I-944 is not just to ensure that you are making a sufficient amount of money right now, but that you won't become a public charge anytime in the future. They are making that determination on the totality of your situation, not just based on the fact that you make 250% over the poverty line (though that is a big plus).

Also, I read the instructions you quoted (regarding income above 125% the poverty line or five times that value in assets) as an absolute minimum. That does not mean that you do not need to provide bank statements though. In fact, the asset instructions say:

"Item Number 9. Assets. List only the assets that can be converted into cash within 12 months. Provide the value of any asset held in the United States or outside the United States, in U.S. dollars."

In the sentence above, there is no ambiguity - they want information of all your assets regardless of where they are. The assets of your household members are optional though. I provided 12 months of bank statements for my American checking account as well as my Norwegian checking and savings account. A pain, and a lot of paper, but the way I read it, that's what they want.

Also remember that even though some people have gotten away with not providing all the information listed, that doesn't mean that they can't reject you/us for not providing the same information. The officers have a lot of discretion. I think the safest bet is to provide them with all the information they ask for.

I disagree with the interpretation - I think that because earlier in the instructions it makes it clear that Item 9 is for the assets that you may choose to list as an option (the part I shared), when the instructions come for number 9 it is already clear that you don't need to list them - and yes, I mean for the household, and I actually have your same train of thought. I guess I should clarify.  My husband (the applicant) has no assets.  0. No bank accounts at all anywhere.  Any assets I list there would be household assets (my assets as the American spouse) and I don't want to list only my bank accounts when I have many other assets.  I feel I should be listing all or none, not picking and choosing - that seems like hiding to me.  The amount of time it would take and bulk it would add to our application to include all of those assets (I have every single option on the dropdown) seems to me not a good choice and almost redundant.  

I can agree that if these assets were my husband's they would make much more sense to include to help with the whole public charge thing.  But as his sponsor and sharing all my tax information, I think that's enough.  However, maybe they did reject me for leaving the table blank.  It now says "N/A" on every line.

The woman from legal aid said that they have lots of people in and out of their organization who have also worked for USCIS and that they do have a point system for cases there, and they get points for rejections and RFEs - part of why they can be so petty with rejection.  No idea how accurate this is but that is what she said.

Gotcha - that makes sense. Maybe consider using the extra space on the last page to explain that your husband (the applicant) does not have any assets anywhere and that's the reason you are writing "N/A"?

I did not include my wife's bank accounts (sponsor) for the same reason so I agree with you there!

New, related question. My husband's 90 days are now up as of today.  Can someone please clarify - do I now need to turn in an I-130 as well, and is there a fee change?

My 90 days are up tomorrow. I sent in on 1st April the following:

 

I-485, I-944 and I-864

 

But  I didn’t send the form you mention above in. S%it was i supposed to?!? The USCIS website says the I-130 carries a fee of $535.

No. You only need the I-130 if you wouldn't have gotten married within the 90 days. You could file in two years and wouldn't need to include that form as long as you fulfilled the obligations of your K1
