Here is all that I included - the first one is for the main application and the second part is for the travel and work documents.

@Duke & Marie for some reason I can't edit that post anymore to tag you there so I am posting again.  Sorry to everyone for all of the space I am taking up on the thread.  I hope maybe all of these questions/suggestions will help other people at the very least.

Thanks so much.  Yes - most of that doesn't apply to us. What do you mean by National Visa Center letter? By spouse's birth certificate do you mean the American citizen? Did you also include American Citizen's passport bio page?

I am on the fence about the bank statements.  I am not listing bank account information as I am 250% over the poverty guideline on salary alone, so I didn't want to muddy the waters.

We got a letter from the NVC about scheduling our appointment with the Embassy , this came after NOA2. Not sure if its required, but i saw others send it in, so figured it couldn't hurt.

Spouse's Birth Certificate, yes American citizen one

Yes American citizen passport as well ( I sent you a private message with my entire cover page.)

I'm way over on the poverty line,  actually being in the military, i have a lower limit, but i also have other income as well so I'm over it. I couldn't see it hurting tho, so i placed it in.

Yes, I got the message, thank you so much! I just didn't want to add 100 more pages to my application..each months bank statement is 10-12 pages so that will be 100+ pages! I'll throw in my birth certificate because why not, though the instructions seem to indicate we just need one proof of citizenship.  But that one is only 2 pages so no big deal.

yes, i know its a lot. and i agree with the instructions saying that.

but maybe im just over thinking, i rather send in extra stuff then risk an RFE/Delays/Rejection.  they can shred whatever they dont want.

If/when my application gets accepted, I'm happy to go over with you on every page to see what the difference is if you want, but im not sure when that'll be.

I see it both ways because I have heard stories of people having issues because they sent unnecessary things or too much - but in this case (bank account statements) they can't really argue it was unnecessary since it it listed as part of what you can include.  Hmmm..

if our AOS package is rejected because of an outdated form issue, can we reuse some of the evidence from the previous package to file a new/corrected package?

Same.

Damn, sorry to see people getting RFE's again. Still haven't received anything for us, worrying. We're now past the point where the K-1 has expired as well, so i'm not sure how that would impact anything if we got another RFE.

The 944 asks for your assets and resources and doesn't seem optional like in the 864, so we included ours. In the instructions it specifically says to includes 12 months of bank statements as proof of assets.

We just included the first page summary of each statement as our statements were too long. That summary page should be proof enough that those assets are there. We also blanked out our bank account numbers because we didn't want them having that type of information.

Thanks, yes I can do that.  I have another 944 question as I continue to pore over everything.  For part 2 where you list the members of your household, are you saying "yes" for is this person filing an application for an immigration benefit with you? Did you say yes for the immigrant? spouse? both? neither?

Since my husband was filling as the immigrant, he checked yes for himself, no for me.

I read a lot on this site, tho i dont remember where, it was here lol (months of reading)  I did take notes,   My understanding is that we are not applying for immigration benefit.

as far as your table of contents, here is what i placed in mine that wasn't in your list. it may or may not apply to you

G1145 form  (i only placed one for the entire packet, i could be wrong in this but o well, guess its not a requirement )

·         National Visa Center letter

·         A copy of the divorce certificate of the prior marriage from my spouse.

·         Spouse’s birth certificate

·         A copy of the DS-3025 vaccination documentation worksheet

·         College Certificates, High School Diploma, English Class 1 and 2 taken.

·         12 Month Bank Statements (Spouse)

·         Copy of Military Dependent ID

My understanding is that the immigrant is applying for an immigration benefit. The benefit in this case is the ability to live and work in the US. The act of filling out these forms are applying for them.

I specifically asked this question earlier in the thread when I got rejected the first time - people are being accepted without filling in that table.  The instructions definitely make it clear it is optional by the use of the word "if" and "you may" and then saying to put this info in question 9 - but I agree if you list bank account information in the table you need the statements to back it up.  I left the table blank (I know at least one other person that did and did not have a problem) but since I am not leaving any blanks this time I think I am going to just write N/A there.

I'm going to change this one to yes since that is the legal aid's suggestion as well as when I googled it, I found this site: https://www.dhs.gov/providing-immigration-benefits-information which makes it pretty clear being allowed to stay and work and have a green card is what they are considering a benefit.  I got more confused about the "with you" part - wasn't sure if I was included in this as the petitioner/sponser.

Sadly, these are not even RFEs - I would be sooooo much happier to get an RFE as it means the case is in progress and they need more information.  These are rejections meaning the case isn't even being accepted into their system yet.

Guess I'll change mine once I get it back lol
