March 2020 AOS Filers

AOS Checklist

  • Cover Letter listing Table of Contents
  • (Check Payable to U.S. Department of Homeland Security - $1,225.00)

 

Form I-485 (completed and signed by non-US Citizen/beneficiary)

  • Form G-1145 
  • Form I-944 (Declaration of Self-Sufficiency) (required as of February 24, 2020)
  • Copy of beneficiary's Passport with biographical page 
  • Copy of beneficiary's K1 Visa from Passport and entry stamp 
  • Copy of NOA2 Approval letter (from K1 process) 
  • I-94 
  • Copy of beneficiary's Birth Certificate 
  • translation of birth certificate (if needed)
  • Certified copy of Marriage License 
  • Passport Photos (2) name written on the back 
  • Copy of DS-3025 

 

Form I-864 (completed and signed by USC) (goes with form I-485)

  • Proof of USC's citizenship (copy of birth certificate, copy of passport bio page, or other)
  • 2018, 2017 (optional), and 2016 (optional) Tax Return (with W-2) or Transcripts
  • Employment Verification letter (updated one - not the one used during K1 process) 
  • Paystubs (last 3 months) 

 

Form I-765 (completed and signed by non-US Citizen/beneficiary)

  • Copy of beneficiary's Passport with biographical page 
  • Copy of beneficiary's K1 Visa from Passport and entry stamp 
  • I-94 
  • Passport Photos (2) name written on the back 
  • Copy of NOA2 (from K1 process) 

 

Form I-131 (completed and signed by non-US Citizen/beneficiary)

  • Copy of beneficiary's Passport with biographical page 
  • Copy of beneficiary's K1 Visa from Passport and entry stamp 
  • I-94 
  • Passport Photos (2) name written on the back 
  • Copy of NOA2 (from K1 process

 

 

Be sure to  double check for the current fees as fees do sometimes increase, so please check. Additionally check the forms as listed above i.e., current version and or edition date, there has been changes to various forms since February 24, 2020. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main  cover letter. Hope this helps in your preparation of your AOS. When in doubt ask questions.

Timeline

Hey March 2020 filers, am currently filling in form i-485 and on the new form for question 62 Declaration of self sufficiency. whats the correct answer? the laws changed end of February however Illinois ( where i am based) is exempt.

I will not be claiming benefits of any kind and i understand i will need to fill in form i-944 regardless as a k1 visa holder... just not sure whether its a yes or no tick.

Illinois is NO LONGER EXEMPT! I am from IL too.  We are included now.  You need to tick "No"

But, by the way @brainless69 even though we are not exempt anymore we will figure it out! I am planning to file by the end of the week.  We will figure all this new crazy stuff out together!

ready for the next question already... 🤣 suspect I won't be the only one with questions regarding the i-944 as its brand new. 

i'm guessing the answer for Q1. is No Q2. Yes is GCSE a high school equivelent?

These questions are specific to the person so I can't really give you a blanket answer! Coming here on a K-1, I would assume that Form I-140 does not pertain to us.  

 

As far as number 2, again its specific to the person and really all about what you can prove.  For my husband, the answer is no, because he has no record of finishing high school and didn't formally finish.  Not being from Europe, I don't know much about the GCSE but I googled it and found this "5 GCSE passes at grade C or higher are considered the rough equivalent of a US High School Diploma (without Honors or 'Advanced Placement' (AP) classes). This will be sufficient for a student to gain entry to less selective US colleges and universities" 

 

So I guess it depends what your scores are? Sorry I can't help more.  I think you would need advice from someone in your specific region on that one.

Thanks kec523 I have put the question into the UK portal and have been getting help there, this whole new form and applications are driving me insane because there is no information out there and not many people have filed since the changes! oh well...guess there has to be a first for everyone.

Once you file you will be a resident  expert on it and will be able to share. I'm sorry I could not be much help on the new forms. I recommend YOU keep a copy of the forms you filed.

Hello guys,

 

I came across the I-944 form and I had a hard time filing it.

How do a K1 visa holder fill the form since as new immigrant we (beneficiaries) do not have credit score, assets, and filled tex returns?

Is there any filled form available as example?

As you may have noticed further up in the thread and on related threads, this is a problem we are all encountering and are unsure how to solve.  Since this form just came into effect last week, there are no examples yet because no one has successfully filed and gone through the whole AOS process with it.  We are the ones to do that first and share our experiences! I am sharing another thread here where we are all discussing the credit score issue that it might be helpful for you to read through: 

 

 

While we don't have the definitive answers about how to do this, we are all willing to talk through how we interpret the form and the questions for our K-1 situations.  If you have specific questions I can try to share how I am thinking about doing it!

Hi all, 

 

Just wanted to share that I sent in my application yesterday, (Saturday 3/7).  I have no idea what to expect as we did not have proof of the "no credit score."  I sent in screenshots of the error messages for the online requests and a letter that explains he does not have a score, and we applied for one by mail as well, but haven't gotten a response.  In another thread about the 944, someone shared that they sent in the snail mail request and it just came back after 3 weeks.  So at this point, it seems maybe the best course of action is to send that in and wait until it comes back and include that in the packet.  

 

Too late for me, but since I sent mine in about 2 weeks ago, I should get it soon and if I get an RFE I will send it back with this included. 

 

Could be I made lots of mistakes on the form - I am planning to share as much as possible so others can learn from them! My form should arrive tomorrow or Tuesday to the lockbox, I'm hearing there's a big delay on even the NOA-1 ever since the Feb 24th push, so not sure how long until I will hear anything! Now we wait!

Yeah I guess your packet will be the test bed in more ways than one. Did you keep a copy of the I-944 you filed?

Yes I sure do! I did the 944 by typing in answers on dochub so I have it there, as well as two copies of our signed version that I sent in!

Very very good as it will serve as an aid for you in the future and you can refer back to it to see what you filled it!!!!
