Hi guys, all of it is a bit confusing. I'm doing a lot of research but I still have some unresolved questions regarding this new DS-5540 form and I hope you can help me with that?

I’m a beneficiary of CR1 visa currently living abroad and I never worked in US. So what I should write in part 4 of the DS-5540 form, since it asks about U.S. federal tax and IRS transcript? Should I put 0 (never worked in US), or enter my income I earned in my country for the past 3 tax years?

Another question about the insurance after I enter the US: will the tourist insurance be sufficient?

I would write it in the comments box that you did not file taxes bc you did not work in the US. So that would justify your "no" answer - that you did not file USA taxes.

As for insurance: I´ve been reading for people to get insurance quotes - with the beneficiary´s name. That way it shows that you can get that insurance upon arrival.

Hi everyone. May i ask who are affected by this new ds-5540? We filed aug 2019 are we affected by this? And my wife is a usc.  Thank you for the response.

I see it on the dropdown menu of "Additional Documents" under the DS-260 form.

Since it´s under Additional Documents, I don´t think it´s necessaritly mandatory for this stage. However, I imagine they will definitely ask for it in the interview. So I would suggest sending it along with the DS-260.

Where does it actually state it has to be uploaded to CEAC? My portal doesn’t have any mention of the document and to be honest I wouldn’t even be aware of this document if I wasn’t on VJ! I’m not opposed to uploading it I’m just curious what source has instructed applicants to upload to NVC aswell as bring to interview?!

Thanks

I see it on the dropdown menu of the DS-260 Civil Documents section.

Another question about the insurance after I enter the US: will the tourist insurance be sufficient?

No, since tourist/travellers insurance usually only covers you for places you are actually a tourist/visiting. Since once you arrive on US soil you’ll be a permanent resident, the travellers insurance won’t cover you anymore, because they don’t cover you for places that you are a resident or citizen of.. so a consulate officer would likely not accept that as an acceptable form of insurance since it won’t even cover you inside the US

Our CR1 Journey:

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)

  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

Interview Stage:

Hey SuperAnia,

I personnaly put N/A (not applicable) whenever I was not concerned about the question (like you and many others, I have never worked in the US and so I have no tax and IRS transcript).

Regarding the insurance, I think they want something a bit more solid thanTourist Insurance. From what I have read, they want you to provid proofs that you are already searching or in contact with a US health insurance. You don't have to provide a signed contract with an Insurance company yet, but you will have to show that you have made proper and serious reseach about it (like exchange of emails, and/or a quote adapted to your case, etc.).

Also I suggest you have a signed contract ready to show on your first day on the US soil, when you go through Port of Entry.

Take care,

Alix

I am in the same boat regarding the health insurance. Can you please explain what do you mean by 'have a signed contract ready to show on your first day on US soil..?" Thanks.

Hey,

Sorry my message was not clear at all. What I meant is that I think it is better you have your insurance contract starting as soon as possible after you arrive on the US soil, and ever better, that it starts the day you cross Port of Entry. I am going to try to have mine starting on that day (of course, right now I have no idea when that will be).

Hope I'm clearer. Sorry for the confusion.

Take care,

Alix

Can your petitioner add you to his/her work health insurance plan? I talked to our HR and they were able to add my wife even if she didn't have SSN, I just have to update it once she gets one.

I guess it depends of the petitioner's Health Insurance plan. In our case, we are working on it with my husband so that I am added to his Health Insurance (weardly they have only one month in the year (which is November) when you can add someone new to the plan 🤔).

Yes that's normal, the open enrollment for most companies' heath insurance is around that time, which is the only time he/she can change their plan. But some offer exceptions due to life changing moments like marriage, birth of a baby, etc.. those events the company lets you make changes within 30 days of the event.
