So, I made my second submission (just a W-2) on January 6. Seeing how it's really close to 8 weeks, I figured I'll just leave it as is for NVC to assess and not add the DS-5540 at this point, right?  Roll the dice and hope for a DQ then just bring the 5540 to the interview if ever? If I submit the 5540 at this point, it's guaranteed 8 more weeks (of torture, lol) for me.

I think it depends on the embassy and how busy they are (or Lazy)

 

I’ve seen some take a week or two, others don’t respond at all.. note: their policy says they’re not obligated to respond to any Expidite request 🙄

 

but if you haven’t gotten an email saying they’re checking in after 2 weeks, call NVC and chase them.. appears they’re very lazy in responding, but that might just be sydney 🤷‍♀️

From what I recall, you can fill out and upload everything, then submit. But let's get others point of view...

USCIS - FILING FOR I-751 (CR1)

May 21st 2022 : package sent (with Fedex / Delivered on May 23rd) 

May 27th 2022: case received with Receipt # (NATIONAL BENEFITS CENTER)

May 31st 2022: NOA received. I-797 (24months extension)

June 11th 2022: NOA for a Biometrics appointment (set for June 30th - need to reschedule it - not in the US on that day! 😱)

June 14th 2022: walk in at the Center - all went well. Biometrics done!

December 8th 2022: Received a Notice of Action. I-751 APPROVED! 🎉

December 10th 2022: New GreenCard received in the mail 🥳

visa  interview this morning in Paris embassy 🙂

Everything  went smooth 

a lot of questions , and they let  my husband come in as he is usc and asked him questions . 

No  questions about DS540 but officer told that it can happen at the POE and to bring proof  of health insurance during the travel just in case if the officer at the POE ask for it . 
 

finally , it happened !!

I just found out about this new DS-5540 thing and went back to look at my submission date for DS-260... turns out it was submitted February 24th to the day.

We just finished submitting all other documents a few days ago. I still don’t know much about the DS-5540, but am I correct in thinking it would be best to just add the document online now even though that would push us back a few days of wait time?


I have read that a lot of people that submitted before Feb. 24th are just hoping they get DQ’d without the online DS-5540 and will bring a filled out DS-5540 to the interview. But in my case, is there really not a chance to get DQ’d without the online DS-5540? I really do not want an RFE

Congratulations! So did you hand the ds-5540 to the officer at all? Also, what is POE? :)

Since you submitted recently, I would add the ds 5540 form just to be sure. I submitted on Jan 15th, so I'm hoping to get DQ without ds 5540, but will bring it to the interview.

1. Have good internet connection

2. Read all of the instructions prior to filling it out. It´s a long form. I would print out the PDF example and look at the items, so you have everything ready.

3. You will need to enter ALL of the addresses where the beneficiary has lived for more than 6 months since the age of 16. If there are many places, I would make a spreadsheet so you can cut and past accordingly - to speed up the process. This is the trickiest page of the form to fill out bc it consistently times you out and keeps logging you off. So I would save after each address is entered.

4. Same for educational backgroud. 

5. Be extra patient!
