Did you also have to fill out an I-864a for his wife as she was part of his household? I’m on the same boat, my brother in law is the joint sponsor for me but he filed taxes jointly with his wife.

we`re in the similar situation. out joint sponsor is married and filing taxes jointly. but we didn`t include his wife`s income in his I864 as a household member because instruction say:

"Item Numbers 8. - 22.  Current Annual Household Income.  This section is used to determine the sponsor’s household income.  If your individual annual income listed in Item Number 7. is greater than 125 percent (or 100 percent if you are on active duty in the U.S. Armed Forces or U.S. Coast Guard and sponsoring your spouse or child) of the Federal Poverty Guidelines for your household size from Part 5., Item Number 8., you do not need to include any other household member’s income.  See Form I-864P for information on the Federal Poverty Guidelines.

so we only included the joint sponsor`s tax transcript and W2 just to make it easier. however ! I do see how it might come up that we need to submit his wife`s W2, so I am suspecting a RFE for that.

On the other hand if you chose to include sponsor`s spouse as a household member then it would be necessary to include I864a and W2 and the whole works for the household member.

I resubmitted one of my document on 6th March’20. Does anyone know how long do they take to review resubmitted documents? Wish you all the best of luck 💕

Hi,

You have submitted this questions quite a few times now. I totally understand your anxious-ness but unfortunately the time is the same (may even be more delayed).. about 8 weeks from submission. NVC updated their page today finally - as of 23 March , they are currently working on Jan 17 submissions.

No, that's what I'm confused about though. We didn't file 864a and they didn't request it . They just said 'please submit every w2/1099 on (person's name ) tax return or transcript. Now I don't know if we will have to submit 864a and transcript for her also.

He filed jointly but using his wage alone.

Maybe we can try to call them again.

I will surely appreciate it jou get any clarity on your end if you can let me know also?

Maybe you should file 864a to be safe.

Some other things may have to go with that also like

Welcome Ptitchou

And yes, the Police certificate is totally compulsory.

It is long to get it from Canada ?

I would submit both 864A and transcript, and if possible (I know it can be embarrassing to ask) your sponsor's wife as well.

Take care all of you,

Alix

Thanks

You're not that far along maybe you can still add it to your documents and not get rfe.

I sincerely hope you don’t get an RFE. See it’s just confusing as his income itself is above 125%and according to Item 8 we don’t need to include any other household income.
I suppose providing more documents wouldn’t hurt or delay the process just to be safe and submit spouse w2 etc as well.

Kindly keep us posted as to what happens with your process. Thank you a bunch!

Yes same thing with me as well. He’s using his wage only. If they needed the whole works of spouse info with W2 and I-864a they would have stated it. Your sponsors income is enough alone right, above 125%? Maybe they want a w2 for the spouse just to see proof of joint filing?

I will ask around and try calling, however please keep me posted if anything new occurs. Thank you!

Basically, it’s transfer from NVC/embassy back to USCIS and have interview here in New Orleans... rate everything is going around the world right now, it will be a similar timeframe..

What is your current status? I believe for some non-immigrant status, you can't submit AOS.

Hi PSB,

I am on the same boat and would like to know the correct response to this RFE as well.

(I wrote a question on your profile page but realized you have answered some of them here).

Did you add joint sponsor's wife as household member of the joint sponsor?

We didnt add her as household member nor we didn't submit I-864A for her neither.

Hi all, finally time for me to join this thread. Got my approval & NVC case creation on the same day, so it was rather unexpected! We're awaiting the processing of payment now, but I'm gathering up all the documents we'll need and I'm concerned about the police record part. Everything is closed down due to COVID-19, so I don't know when I will be able to get my fingerprints done. My husband has transcripts for 2016 through 2018 (he's self-employed, so we read we would need 3 years to be safe) but hadn't filed 2019 yet. Hopefully we only need that for the interview, given the extension right now.

Does anyone know if it's possible to defer the police certificate to the interview stage or will they require it now?

Same boat for me and I look screwed for the foreseeable. I have a UK police check from a couple of months back, and will get my Colombian one fairly easily. Getting one for Korea from the embassy......no idea how I'll go about doing this. I'll be fined/arrested if I attempt to go to the embassy in Bogota for this.

  • In response to significant worldwide challenges related to the COVID-19 pandemic, the Department of State is temporarily suspending routine visa services at all U.S. Embassies and Consulates. Embassies and consulates will cancel all routine immigrant and nonimmigrant visa appointments as of March 20, 2020. As resources allow, embassies and consulates will continue to provide emergency and mission critical visa services. Our overseas missions will resume routine visa services as soon as possible but are unable to provide a specific date at this time.
