AOS: Filed June 10, 2020, Received June 13, 2020, Cheque cashed July 16

(I-130 approved in Oct 2019 because we were originally doing consular CR-1 processing)
NOAs July 24 (dated July 17) 2020
Biometrics Jan 7, 2021 (notice dated Dec 12, received Dec 22)
Case updated to 'Interview Scheduled' (Jan 19, 2021, received letter Jan 25)

February 24! Interview! New Card being produced!

Feb 25, 2021: Case approved.

March 1, 2021: Card was mailed

March 4, 2021: Green Card Received! 🥳

March 25, 2021: SSN Application
March 29, 2021: Received SSN
Dec 5, 2022: I-751 ROC Delivered to Lockbox

its mailed to the address you put on the DS260. I believe they confirm the address at POE also.

Hi all - I think I know the answer but want to get feedback from the community to confirm...

 

We received our DQ notice (hooray!) However, I have a case review note that says that my income does not qualify me to be a sponsor and that my eligibility will be determined by a consular officer at my wife's interview. I worked entirely outside of the US in 2018 so my 2018 tax return shows foreign income (but is many times the required amount) which was decreased below the amount required to sponsor due to foreign tax credits. Did I receive this note because my income in 2018 was all foreign income and reduced by the foreign tax credit?

 

I have since moved to the US and am still making more than enough money to sponsor. I am planning to have my wife show my US job offer letter and pay stubs, (both of which were also uploaded and accepted by the NVC) as well as a copy of my 2019 tax return and transcript at the interview, assuming we have it in time.

 

Any other recommendations? Anything I should be concerned about? A joint sponsor is not an option for us.

Sure can. I didn't include the 5540 form, since the directive for implementation came about around late February and it was nearing 8 weeks since my second submission, so I figured I'd just roll the dice in not submitting the form and just bringing it along with me to the interview. Since my wait counter would reset anyway regardless if I submit the form on my own volition or got RFE'd for not having it, I just bet on the hope that they'll DQ me without it. I would have probably uploaded the form if I were, say, on week 4 of waiting for review or if my second submission was on February 24th or beyond.

As others have said, the lack of a message about your case being DQ'd is a mark that they're doing an RFE. When I got RFE'd, I also had an "NVC Feedback" message sent to me. They were asking for my joint sponsor's W-2 form (mistake on my end to have not included it), but accepted all other documents submitted, so my case's page looked similar to yours, with the index page showing the documents' statuses as all "Accepted" even though my case itself wasn't DQ'd at that point. Hope this helps. :)

If the two cents of a dude still navigating through the immigration process is of any worth to you ( :D ), I think as long as you can make your case at the consulate that your current job pays well enough to sponsor your wife, you should be good. Like you said, it's best to have your wife bring pay stubs, employment contract, and similar documents to her interview. Maybe also bring in some extra financial documents just to prove that she won't be liable to become a public charge? Wouldn't hurt to bring an excess of documents. Best of luck to both of you! :)

Hey- update.  The messages did load eventually.  Apparently I added my mother as MY household member, not my father's household member.  I have to re-add her as my father's household member and resubmit her documents.  I find this very odd because I feel like I wouldn't have made such a silly mistake, but I have no way of verifying if it was truly my mistake because they already removed her from my CEAC account.  I called and asked if it would be another 9 weeks before they even look at my case again, and of course the woman said she couldn't make any promises and then gave me a long speech about not rushing through the submission and that it would be all worth it in the end 🙄.  I appreciate her partial empathy (lecturing?), but I feel like I've been punched in the stomach thinking of another possible 2+ month wait.  It's so unfair that ONE little thing that would take no time to review sits in their queue for two months.

Submitted 01/09/2020 - first and only submission. 

 

I did not submit my DS5540 Public Charge Questionnaire but it was advised by my Lawyer to fill this out and bring it to the interview.

Last week they were reviewing 14th and 15th, today 9th.What about the 8th 7th...

I made the same mistake. On to my 8th week for my second submission and I havent heard anything from NVC 😪

Could someone please help with this?

 

Appreciate your feedback regarding a 1099 document that I uploaded as part of additional AOS as a petitioner and this upload is tilted left. Considering that all other documents were uploaded fine and this one being an additional AOS, would NVC reject this and need a fresh upload? I did call NVC and was advised that NVC has not been rejecting such documents since last few months but it boils down to the document reviewer. Going back in line for this is causing a heartache 🙄

did you upload the 2018 tax as the “required” income form or under “additional”?

Only US based income and assets qualify. You should be good if your 2019 US based income is 125% above the poverty line, but make sure that your spouse bring all (original) documentation to the interview.

Wow! I got an email this morning to say they were reviewing our request and after that I was thinking about yours and whether there was any news.

I was 100% sure they would approve it. How is it fair to others to delay you? I don't think anyone has the mentality that "someone else should be delayed because unless I can be sped up too then it's unfair". (Not that you're even being 'sped up', they're just balancing out your wait time after you were so heavily delayed)

  • April 26 2019: I-824 NOA1 (NBC) (Change from AOS to Consular - mistake on I-130 😭)
  • January 24 2020: I-824 NOA2 (273 days)
  • Feb 5 2020: Approved I-130 Sent to NVC (12 days after I-824 NOA2)

 

NVC Stage:

  • February 12 2020: Case Received @ NVC (7 days after being sent)
  • February 16 2020: Expedite Request Sent - Financial Hardship
  • March 7 2020: Case Number Created (23 days after NVC receipt)
  • March 7 2020: IV & AOS Fees Paid (Showed as PAID after 4 days)
  • March 13 2020: IV & AOS Docs Submitted
