i actually got my interview letter today for 16 april. do i have to register my appointment for Senegal embassy..

Timeline

I was approved for my IR1 visa on March 16th, 2020.

My visa has already been picked up for shipment. Will keep you posted about POE. Canada-US borders are a little confusing right now.

At least that's my reading of it.

In terms of immigration, it would still be due by the original tax day, as they go when it's supposed to be filed, not fees/penalties.

Dear All, I have a unique situation now.  My spouse's CR1 visa was approved. But she is not able to travel now because of Corona Virus restrictions and no flights.  What if she is unable to travel because of these Corona virus travel restrictions during the next 3 months and her CR1 immigration visa expires ? 

 

Can we get an extension on the visa or ask for a new visa on the same I-130 petition ?  Or  do we have to again start the process for I-130 petition ?

 

Please help with the query.

You can only get the visa reissued. She will need to provide new medical, visa fee and a letter to explain why she couldnt travel and then submit her passport to the embassy.

Unfortunately you are not on a unique position at all. Many across the world face the same. The expectation is that visas will be reissued .. depending on how long it takes, that will probably 

involve  a new medical and police check before reissue

Not sure if anyone has any experience with this, but my case was DQ in jan of this year. I sent an email to nvc in that same month requesting a change in interview location (charge country is Guyana, interview is in montreal, canada). I wanted to change interview  location  back to Guyana. I send driver's licence and other docs for the change. Got email yesterday as follows:

 

Dear Sir/Madam:

 

The correspondence submitted is currently under review. An appropriate action will be taken once this review is completed.

 

It took two months to get this email, so my  concern is, would this take another two months for the review to take place or is this a faster process?

Hopefully the travel ban will pass in 6 to 8 weeks. But it's not guaranteed. 

 

In that case...

1) you won't need a new police certificate, since they are actually valid for 1 year (even though it says 3 months on it, the embassy only needs it for one year out). 

2) you may need a new medical because they are more strict about this

3) it's doubtful you will have to pay a new visa fee, since this was out of your control. I'm fairly certain that they will merely issue a new visa since you were unable to travel during the ban

2) Yes, a new medical would be needed because the visa validity period is constrained by the medical exam.

3) I disagree. Why does it being out of your control mean they will waive fees? I mean...I don't claim that they will not make exceptions, but exceptions would need to be put into place for that to happen.

RE #3, just my opinion based on the underlying principles of Force Majeure :) 

In effect, since the US cannot fulfill its obligation under a valid visa (i.e. travel restrictions due to the current pandemic), it's assumable (not guaranteed) that under that obligation, it would waive a fee to reissue or extend the visa.

A visa is not a contract, so I would not presume Force Majeure applies.

The US has no obligation here. The US is not even preventing travel in that user's case (spouses of a USC are exempt from the ban)...the issue is finding an airline, which is a private sector issue, and local travel restrictions.

 

The FAM as written says a new visa fee would be required. Users who have contacted the consulate and received responses have reaffirmed that.

Example:

 

Can exceptions be made? Yes. But unless that happens, assume policy will apply.
