Hello,

My name is Jeff and my fiancé lives in Brazil (Governador Valadares). My lawyer received the form acknowledging receipt of my petition mid Feb. 2006. Recently my lawyer received another request for additional evidence etc. It was good timing because I had just come back from my second visit to Brazil to see my fiancé (RIO). My layer said there was code on the document that indicated to her that it was the last time they could request anymore information and we were getting closer to the end. I promptly got all of my receipts translated and put together all the pictures of the trip and sent it all to my lawyer. I've made two trips to Brazil to see my fiancé. The first time I flew to her home city where I met her entire family. The second trip was just for us so we met up in RIO and spent 14 days on the beach in Copacabana (be careful over there, really).

What should I expect next.. I assume an interview...? When will they request my fiancé’s medical examinations...? If we get a letter asking us to come in for an interview do I also have to fly back to Brazil again to attend..$ Any information on this would be helpful and appreciated

You will not go to an interview--just your fiance. After USCIS approves your case, it will be sent to NVC, then to Brazil. The Embassy in Brazil will contact your fiance (by mail) and give her directions about the medical exam, interview, and paperwork needed. You do n ot need to be present at the interview. Some embassies allow the USC, some don't.

The request for more evidence is called an RFE here. I'm surprised your lawyer didn't do a better job looking over your evidence before you sent it in. There is no "last time" for an RFE. Although the RFE will usually ask for all the missing information/evidence, it is possible to get a second RFE.

Initially I sent one package of information after my fist trip. It included passports translations), birth certificate, all my finace's paper work (translated) etc. Soon there after they requested some additional photos of me so I sent them to my lawyer and she sent them in (she said it's a good thin that's all they're requesting). Then a few of months went buy and they requested more evidence..? My layer said we would present the second trip during the interview? Anyway the form was requesting all of the information I had already sent to my lawyer to begin with. I called the laywer and she said just send me the new stuff from the second trip and she'll attach copies of what she already sent in..? I' starting to think the lawyer may have dropped the ball? I sure hope she hasn't, we're comin up on 4 months into the process.. :blink:

If she (your lawyer) has requested further evidence from you twice, she has most definitely dropped the ball.

You'd do yourself a world of good if you'd read the guides on this website and get an understanding about the process on your own (instead of relying on someone unreliable). I just hope she doesn't cost you anymore time than she already has.

This website has directions in English and Port. You can download all the forms your fiance will need after NOA2 . If you check out the embassy reviews for Rio you can get a picture about the interviews. Good stuff. On there you can also see in what order the papers need to be when your fiance goes to her interview. You guys can also see what type of questions the interviewer asks. Its always good to be prepared.

What I did. Worked for me, but I'm no expert. I got all my So's info. and filled all the packet 3 papers out and sent them to her. I did this prior to getting NOA2. Actually still haven't received the hard copy but that's another story. Anyway, when I got my NVC notice, I waited a week then told her to send in to Rio, ds-230, ds-2001, passport photo, copy of passport. A week later we received an interview date, I think the same day she received packet 3 in the mail. By having everything filled out ahead of time you can save some time. You do not have to wait for packet 3 in the mail.(worked for me) Our NVC notice was dated 21 May and she sent in the papers on 3 June. She received packet 3 on 13 June. She did her medical on 13 June.Her interview is 24 July.

Before you send any papers to Rio make sure you have the case #. Also for the medical you need the Case #. For Brasil, you can do the medical ahead of time. They are not going to make an appointment for you. There is a list of accepted doctors for Brasil around ( someplace). Have her see which is the closest to her and do it a month or so before the interview. She needs to tell the doctor the case #.... and bring a passport type photo.... The number of doctors outside Rio is not many. There was One in my SO's state, so she had to go about 120 miles to get there. Now she's planning her trip to Rio, 800 miles away or so...

Too bad about your lawyer. You should ask for your money back. If I were you, I would get rid of the lawyer, Read the guides and posts on VJ and ask ?'s....I don't think you could do any worse. Unless your situation is complicated.

Almost forgot,

Have your fiance do the required shots prior to the interview. There's a list around. My SO did her's prior. She had some for free at the POSTO and some she had to pay...She had one every two weeks or so, what a wimp. Have her bring the Immunization card to the medical exam, otherwise she'll maybe have to do them again.

There are no immigration doctors even close to my husband's hometown/state.

But that wasn't a problem - he had his blood tests and x-ray done where he lives and had a medical done a few days before the interview (in Rio).

One of the civil surgeons in Rio, Dr. Joaquim, gets all done in a day, so if she flies to Rio a couple of days before her interview, she can get the medical done in time. His office is actually IN FRONT of the consulate.

Our experience with Dr. Aurelio was great - and he allowed my husband to bring all of his exams with him. This was less stressful for us.

USCIS approved the case aug 1st and it is now at the NVC in New Hamshire. We're supposed to hear something within the next week or so. Getting excited!!! :jest:
