Yeah, that really stinks. If my memory serves me correctly, it also seems like the NVC requested (on their contact page) that people not contact them regarding the status of their case. I remember that message was there for quite a few months in 2020. It leads you to believe that they were trying to control the number of calls when delays really started happening. But it stinks for anyone who may have thought “okay, I will be patient and wait” . I would be interested in knowing more detail regarding this particular person’s case. I do see this on the “Contact NVC” page:

 

“Immigration and Nationality Act (INA) section 203(g) provides that the Secretary of State shall terminate the registration (petition) of any alien who fails to apply for an immigrant visa within one year of notice of visa availability. The petition may be reinstated if, within two years of notice of visa availability, the alien establishes that the failure to apply was for reasons beyond the alien’s control. Therefore if you do not respond to notices from the NVC within one year you risk termination of your petition under this section of law and would lose the benefits of that petition, such as your priority date.”

 

I wonder if this could apply to them? Who knows. They could try reaching out to the NVC and state the obvious, which is that covid has shut everything down and request their petition be reinstated.

Im assuming we have to contact the consulate as it gets closer, but they will just tell us they are not processing k1 visa and im assuming they will extend the expiration date of the noa 2 due to covid

I’m referring to the NVC, where it states you have to contact them within a year or else they will close your case.

So if our petition has gone from NVC to the embassy we should be ok?

That’s what I don’t know, I’m at the consulate myself, and so was the Facebook person who petition “expired”

One can only hope!! I would be devastated if we waited for a year or longer, only to find out we had to start over. 


I had heard that an updated letter of intent to marry will be needed at the interview. It wouldn’t hurt to get an updated one now and send it to the embassy via email, if they have your petition, and make it clear that you are still waiting for your visa. Better safe than sorry? Lol

Hello! I can only speak for Italy, but I am case ready at the consulate since Dec '20 and I asked for a renewal of the NOA2 some weeks ago because my NOA2 is almost 1 year old (March '20) and they told me the Consul granted it. So I'd say e-mail your consulate to be sure it's renowned.

I know Peru is still in bad shape. What I am unsure about is if our petition will still be pulled with the March 2020 approvals or if it has been moved to the bottom since they rerouted it..we will find out in time. If you go to the regional discussion board there are quite a few people discussing Bogota so it may help you decide. 

Thanks so much for the information. I just found out Lima has resumed processing visas. Hopefully this means they will finally send our case from nvc to Lima. I hope this is a quick process. If they are going in order starting with March and April then mine could possibly be considered in June since I was approved in July. But either way I hope this works out quickly for the both of us!

That’s awesome news! I hope you will hear something soon from the embassy. I confirmed with the NVC that they will be sending petitions to Colombia by order of approval date, once Colombia begins accepting them. I am sure it will be the same for Lima. Keep us updated!

Amazing!! Were you processing in Bogota (just a guess since you have your country set to Venezuela)? And did the embassy already have your petition the last year or was it stuck at NVC until recently (edit: I see now the NVC sent your petition back in April. Don’t mind me, it is late and I am tired 🤣)? I see your NOA2 is just a few weeks ahead of mine. So exciting to see people in our group getting approved ❤️

I know the embassy in dominican republic is still close for routine services unfortunately however i want to know if something needs to be done regarding the NOA2 that are expiring this year for example mines expires march 24 do i have to send a email to NVC or what? Im so confuse and worried about starting over..the current status on my case is still at NVC it never got shipped to the embassy and the thats when covid hit

Don't worry about the NOA expiration date, mine had expired since July 2020 and I'm having my interview next month, once your petition ships out I'd recommend you to have a more updated letter of intent to marry so you can show what your intentions are still

I didn't have to do anything either with NVC nor the embassy btw
