Hi all ,

so my USA born citizen husband is unemployed, he used to receive ssi when he had mental issues and was suffering irritable bowel syndrome . He got off SSI to try to get a job but The IBS and more mental issues made it impossible for him to be employed . He reapplied for the SSI which we are waiting for the results . Now, can he sponsor me with the adjustment of status, will I be denied because of the new public charge rule since he’s currently unemployed, used to receive ssi and has currently applied for Ssi ? . I have never received any government assistance. I came here on tourist visa , please help

He can sponsor as long as you have enough financial support that meets the public charge criteria

Not to rain on your parade however the mere fact that you auntie do-sponsor makes more than the minimum income requirement does not mean you will pass the public charge criteria. People are being denied on public charge despite passing minimum requirements. They look at that totality of your situation.

For example what’s your profession? Do you have a profession that will more easily find a decent job in the USA? Hypothetically if you were an engineer you would be less likely to be refused on the public charge than someone with only a high school certificate.

Just another random guy from the internet with an opinion, although usually backed by data!
