I was wondering if I would have just reason to expedite my husbands form 130 and following processes. PD is March 29, 2019. We have a baby and I am in Florida waiting for him. He’s a doctor but it’s expensive to convert money from rupees to dollars. As well as he is gotten a job offer here in America as his scores as a doctor were good. And most importantly, my son needs surgery, his pediatrician has asked to wait till he is around one and he is 5 months today. I don’t want my baby to go through surgery without his father and I need him here because I’m weak. Do you think under these grounds I could ask for an expedite? Thank you so much!

The USCIS website has very specific reasons for a qualifying expedite.  IMO your case doesn't qualify, but you can always request it.  The worst they can say is no.

Free to ask, why not.

You can request it and hope for the best. Nothing you noted jumps out as a strong case, but I've seen weaker ones approved too.

My suggestion would be to focus on one good reason to expedite, not listing a few possible reasons like you have done in this thread.

Namely, having to convert money (and support 2 households) is something nearly every separated-spouse case goes through. Him being a doctor implies (although not always the case) that financial hardship is probably not a strong case. His job offer is not a strong case either - only if the company would be at risk of failure, and I doubt that is the case here.

Expedite criteria: https://www.uscis.gov/policy-manual/volume-1-part-a-chapter-5

Note that expedites make the process faster, not fast. Expect at least a few months still in the best case even if approved. NVC/consulate processing require a separate expedite.

Yes, this can qualify. I had a family member who kid was born premature. the mother was able to invite parents to visit. Not an expedite visa, but guaranteed visa for grandparents to visit.

you will need your doctors' note stating how important is surgery and child's both parent must be present.

Would my sons surgery not expedite his case? He’s so small and like I just don’t want to see him under general anesthesia alone. Especially if he hasn’t seen his dad.

which stage of the VISA are you? NVC or at USCIS?

i doubt premature birth guaranteed the visa of the grandparents.

How can a doctor state that child’s both parent’s must be present?? Surgery won’t be done in front of them.

It wasn’t just premature.  Baby had to stay in hospital few months and surgery was needed.

doctor doesn’t write letter. Assistant does. They just sign it. Both parents must be present as it’s a psychical things.

sometimes procedure aren’t done correctly and last minute decision has to be made by parents. They need decision making partner.

the letter must only state medical reasons why baby can’t travel to meet Father. Don’t have to say you are weak. Make it all medical which it is

I'd say go for it, the worst that can happen is that they deny your request to expedite.

Recently, someone on VJ was able to expedite just because they wanted to spend the spouse's birthday together... It doesn't seem like grounds to expedite but they were able to anyway...

I'm sorry to hear about what you're going through, hoping for a speedy immigration process for your husband, and for your baby to be well.

Just for some clarification, nothing guarantees a visa approval. Especially non immigrant visas.

OP can request and it is in the best interest to do so. But be aware that a denial is still possible.

Neither an immigrant visa nor a non immigrant visa is a guarantee. That is the point we are trying to make.

It is good that your parents got theirs but that does not mean someone else will.

There was a member on here who tried to get an emergency B2 visa to see her mother who was in the US on her deathbed. She just wanted to see her mother one last time. She was denied.

When you make a statement like this..

it can come off as there is a way to guarantee a visa. Just trying to make everyone aware that that is not the case.
