hello everyone!

so I have a dilemma, I have a trip coming up on March the 12th to go see my husband in Guatemala. I have not seen him in 7 months because of my job. We have a lawyer and hopefully everything will be submitter quick and correctly (but who knows). If they approve everything we are thinking 4 months before he is here because Guatemala doesn't take long to schedule interviews. We are thinking of calling off the trip because I don't want to go and comeback and 2 months later be asking for time off at my job again because they might not approve it. Question is! if I don't go would the official at the interview look at it weird that I did not go see my husband for almost a year? we have been together for 4 years and 1 year and 2 months married and I usually go every 6 months. any comments will help. thank you!

Not visiting one’s spouse living abroad for a year is not a problem as long as you have other good evidences. Judging by you marital history, it seems you do. I hope you front-loaded tons of evidences. Good luck.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

Your  I-130 was approved in January so presumably will be valid until May, so the visa interview will probably happen in April.  Seeing you husband one month later won’t make a difference to the CO.  
 

I would hold off traveling until you know the visa interview date.  Also hold off canceling the ticket because there is a chance that ticket will overlap with the interview date.  
 

Wait until March 11 to cancel.

what do you mean it will be valid until May? I'm a lil familiar with how NVC works but not to much, we paid our fees yesterday and is still in process, we are thinking one or two weeks before we can submit paperwork and then NVC takes 2 months to review paperwork and about a month an a half to schedule interview so we are thinking in June or July he will have his interview. why you think he will get his interview in April? that would be really awesome. thank you!

You were the one who said Guatemala is pretty quick.  Quick does not mean July to me.  

 

Look at your NOA2 from your I-130.  It should have a “valid from” and “valid to” dates.  If the visa is not issued between those dates then the I-130 expires and you have to start over.  
 

However if you file the DS-260 in time with the required documents, and continue to meet deadlines set by NVC and embassy, then your I-130 is extended by the embassy.  
 

Still it does seem like cases for F2A at least for Guatemala sit in NVC for at least 4 months so who knows.

ooooohh, I will looks at it today but I thought it was a year before your application was considered abandoned.

I-130 approval doesn’t expire.

Don’t worry, now that your case is at NVC, just go with the flow, don’t worry about i-130 expiry as it never expires.

Don’t worry, now that your case is at NVC, just go with the flow, don’t worry about i-130 expiry as it never expires.

I don’t think it will hurt to not go if it’s a problem for work.  From when I went to my husband’s Interview and looked around and reading this site, I think the majority go without their spouse for the same reason.  It can be a tough trip to schedule because people have limited vacation time and funds.

 

 In the majority of cases it looks like the approvals are already done by the time they get to the interview and I don’t think it changes the outcome unless a case has issues.
