Good day house,

i have been reading and read AOS on tourist visa is a termed as visa fraud.

 

My confusion here is that my husband called the USCIS to ask if they have any idea or advise on what can be done in a country with travel ban.  He guy advised him to get a tourist visa for his spouse then when file for Adjustment of Status since my husband is a born America citizen, and can get a waiver for that. but people with who came from other countries and become citizen cannot adjust status on tourist visa for their spouse.

 

I just want to know if he was given the right advise.

1)  No one can "get" a tourist visa for someone else---or have any say in the process itself/sponsor someone for a tourist visa.  Each person applies and is approved/denied based on their own merits.

 

2)  One cannot enter the US on a tourist visa with the intention of adjusting status.  This is clear immigration fraud.

 

3)  There's a reason why many of us here call them the "MISinformation line"....they led you wrong, my friend.

July 21, 2017 (Day 07) -  NOA Receipt received in the mail

July 22, 2017 (Day 08) - Biometrics appointment scheduled online, letter mailed out

yes i am to apply for the tourist visa here in my country not my husband.

thank you for the reply.  i dont want to have a wrong record or have any problem in the future with the application/petition. we will see if i can get a tourist visa  to visit and come back, hopefully our country ban will be lifted soon.

I concur with @Going through.  He received very bad advice.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A tourist visa for a spouse in Nigeria is almost certainly not going to be approved. Don’t think you’re the first one that thought they could bypass the ban by applying for a tourist visa. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

and I predict we will see an increase in current B2 holders being denied into the US at the border due to greater suspicion and scrutiny.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
