That is different than applying to be count as “resident for tax purposes”

non-resident and resident for tax purposes is very different overall

Obviously it's different.

That's why there is a form (you've mentioned before), to make an election to be treated as a resident for  tax purposes. And the Form is "Election to File Joint Return with Nonresident Alien Spouse.

Just pulled from our software, Ultra Tax CS. Same story as OP's. Sent electronically in 2018. Zero issues.

It used to be impossible to e-file because of the Form. But now you can.

Again - to have that form filled automatically you have first to make an election in the software -  MFJ: Elect to file joint return with nonresident alien spouse.

I see the software you used has this option. I filed on 2018 and it had to be regular mail filing.

It is not a form but a statement that needs to be made. Obviously the software you are using added this option to create an election statement. That’s pretty much it. I believe it wants you to sign and scan it or something maybe? Either way nice improvement.

so OP if you want to e-file that software looks like a great option. TurboTax and many other softwares did not have this option when I filed last year so I don’t know about this year.

Sorry, yes, you are right - it's a statement, not a Form.

No, nothing has to be scanned.

I think it became available in 2018, this option for e-filing.

Once you select that MFJ with Non-resident  spouse/taxpayer (full-year or part time), the Statement pumps out right  "there",  with names and stuff, in each copy -  for Government (IRS, e-file), client's copy (printed version/e-mail) and  tax preparer/filing cabinet as well.

Of course, general info like taxpayer's and spouse's names, DOB, SSN , address - has to be entered BEFORE the election is made.

In place of signatures - taxpayer's and spouse's names printed. IRS "recognizes" that as an electronical signature when e-file.

But sure, for peace in mind, it's definitely a  good idea to print the Statement, then sigh, scan and attach to a Tax Return as a pdf.file.
