Hi everyone!!

 

I am currently preparing my I-130 and i-485 concurrent filing. I know that the form i-944 requires for the applicant to have health insurance. I have never had health insurance here and I missed the open enrollment period to be added onto my husband's insurance through his work. It is always during November/December months. I also know that they require for health plans to be adequate as explained here :

" An officer should generally consider whether a plan meets the requirements under the Affordable Care Act in limiting cost-sharing, including deductible, copayments, and out of pocket maximum amounts."

 

Am I better off paying for a short-term plan from today until open enrollment period (Nov/December, to be added to my spouse's plan) just to show that I have some kind of insurance, even if it does not exactly meet their standards since short-term plans cover very little and their deductibles are super high, OR, am should I just explain that I don't have insurance currently and that I will enroll when it is time? 

 

In other words, do you think short-term insurance is going to help my case for now or is it as bad as not having no insurance at all?

When did you get married? Marriage usually counts as a qualifying event to add someone to a policy, but it has to be done within a specific time frame. 

 

I would say that any insurance is better than no insurance. You can get a short term plan now, and add an explanation that you will be added to your spouse's policy as soon as possible.

We've been married for more than 60 days so they told us that the only way is to wait until November to add me. 

 

That sounds like a good idea, I am going to do that because that sounds like the best option for me at the moment, thank you again!!

Same issue for my husband. I was originally told by our benefits people that i could not add him until he had his visa, but it was apparently incorrect info and i could have added him all along. now we have to wait until open enrollment for 2021. I asked my company to write a letter stating he qualifies to be added to my insurance during the next open enrollment period, I havent heard back yet if they are able to provide it.

Oh that's a good idea! I hadn't thought of that! Let me know if it works you! I am still looking at short term insurances, it's crazy how they barely cover anything.. but if that's my only option for now then I'll go for it.

Have you heard back from your company yet regarding whether they can provide this letter?

 

Debating whether we should do this, as well.  I guess it's worth a shot!

We did receive a credit report type document in the mail about 10 business days later! All it had on it for my husband was a credit card I’d added him to as an authorized user, but I’m glad we were able to get something, god only knows if we hadn’t and uscis denied for it or something!

Was your company able to provide the letter regarding health insurance?
