You will likely need the EAD or Green Card to get a name change on the Social Security card.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You are exactly correct.

 

Interview for GC is on March 10th, need to get to bank with state ID before end of month to get bank statement with both our names on it, to get the state ID we need to get bank statement with both married names on it need EAD, EAD is supposed to come in the mail anytime.  Gotta love how this immigration stuff comes down to a matter of days sometimes lol

 

If anything tho, the bank said we can go in the first week of March and with getting my wifes name changed to married name, we can get a verification letter of the bank account with both our names on it.  If all else fails and EAD takes too long to get here, that is much better for joint info than nothing.

 

In another note - question - I know you need an EAD card to get your Social Security Card if you didn't within the 90 days.  She got hers during the 90 days (even with having verification issues :dance:), although her Social Security Card is still in her maiden name (can't believe I haven't thought of this for some reason it was in my head needed EAD to get her name changed to married on SSN need EAD), but maybe can just take in the NOA1 for I-485 to showcase that her name is registered with her married name now with DHS. Hopefully this should suffice to get her name changed on her Social Security Card to married?  Can hope!

 

 

It does not really matter if the bank account shows her last name, or yours.  Changing name adds an extra layer of contacting everyone to change the accounts in your name, but that can be done at a later time.  Many couples do not have joint accounts - it is one evidence, in a sea of many possible ones.

Depending on your state she might be out of luck. The filed I-485 is not a legal status.It is more like we tolerate you but you are not a resident.   On the NOA1 has like twice a sentence with like 20pt of text saying it doesn't give any immigration benefit.

If the K1 is still valid she might be able to get a state ID with that for 3 months (90 days after she entered)

Right now the legal status she has/had is the admitted until on the I-94.

 

If nothing works she will need to wait for the EAD or greencard to be able to get a state id/drivers license.

For those that are about to go through the k1: Another reason to file within 90 days- no need to worry about any unauthorized days. 
From what I’ve seen a state ID can be obtained within the first 90 days since you show legal status or after an EAD or GC is received. Same applies to the SS.

Exactly they wanted to see the EAD but agreed that we are doing things properly, so when we get the EAD going back and getting the state ID and hopefully happens before the end of the month so can get all joint evidence gathered for the GC interview on 3/10

She can be added to bank accounts without a state id. She can use her passport.... It worked for us. The only thing might be hard is getting a credit card since she cant prove her residency, but for joint account it shouldn't be a problem.

She's on my bank account, but they would only add her with her maiden name since she has no id yet that has her pic+married name, and first thing with that will be her state id, need the EAD to get state id to add her to my bank account, also need the EAD to get her ss card changed from maiden name to married name.

 

They all work together in conjunction with the EAD

Here in VA I was able to apply for the new type Real ID driving licence (with the cute star) while on K-1. The DMV wanted my I-94, 2 proofs of address (gave him the lease agreement and a car insurance, both with my name on it) and my passport. 

 

They told me I was eligible because I had applied within 60 days of entering the USA. Which means that after those 60 days they would require me to present a GC.

It might be different per state (zoals alles :p ).

This should not be a problem for the GC interview.  You're both on the joint bank account statements, and you will have your marriage certificate to show that it is her.  Don't worry and good luck with the interview!

Ahh. We didn't care about name change so we didn't have this issues. 

You will be able to sort it out once GC or EAD

There is no Federal reason to not provide an ID. Your NOA is an acceptable. At state level you need to find out what the official state requirements are. some states accept the NOA and others do not.

Just because a DMV clerk says something does not make it the official rule. Check the state DMV site

Virginia is slightly different, Richmond got so fed up with all the calls that they now run all non-citizen applications through the state capitol. They also no longer restrict the validity to a year if you show an NOA for an ROC as proof. I was not aware that they did the same thing for a K-1 but that does make sense.

Note that sometimes the DMV sites are wrong too or at least not updated frequently. Ours showed the I-797 was accepted, but  the lady at the DMV turned her screen to show us that the NOA wasn't an option to pick to use as proof to obtain a DL or ID.

We ended up waiting until my husband had his GC to persue it, bringing in the "accepted documents" paper meant nothing because their screen didn't allow them to input what was suppose to be accepted.

Nope that is the whole problem. The system they use to verify your current status (SAVE) does accept I-797. It is not a standard entry and they need to pull out the book to get the correct code. By bringing the print out of the website, you may actually convince them they need to get up and look for "the book".
