I mailed in my I-130 and has been received I am at 4 months waiting for approval or denial. I am trying to establish if i can be the sole Sponsor or if I need a Joint Sponsor. My wife is Thai and we have been married since 2014. From 2015 to March 2019 i was living in Thailand. Living in America now.  I started working in May 2019 and from May to December 2019 I made 37,800$ which is on par with the poverty  2019 requirements for a family of 5 at 37,700.

 

Things I am worried about:

I did not work i Thailand so i have no tax return for the most 3 recent years but will have my tax return for 2019.

I did not work for my employer for a full year yet.

Will they take into account that I met poverty requirement under a year and if I send them my pay stubs as well will that be sufficient.

Can my wife add any assets that she has in Thailand.

 

Also on a side note: When I sent the i-130 the attended place we were planning was in NY.  But a couple weeks ago one of her friends in Cali  has a job offer for her  with a high salary.  Can I use that as supplement for  income? Also anyway she can work after getting approved for 130 and before  the whole process finishes and she gets her green card?

I did not work for my employer for a full year yet.

Will they take into account that I met poverty requirement under a year and if I send them my pay stubs as well will that be sufficient.

Can my wife add any assets that she has in Thailand. No.

Also, no.   Also anyway she can work after getting approved for 130 and before  the whole process finishes and she gets her green card?  Not sure what you mean.  She is not currently in the US, right?  She can work upon entry, even before the physical card arrives in the mail.  Her passport will contain a stamp that serves as evidence of her LPR status.

I think you will need to have a joint sponsor lined up, as your income is marginal, and there is renewed scrutiny for the public charge.  You will also want to have a plan in place for health care coverage for your wife.

An approved I130 does not grant immigrant status. She cannot move to the US (if she’s outside of the US) or work just on an I130

USCIS Stage:

Your "Current Income" as an employee does not come from a tax return.  Your income will be the gross for a full pay period times the number of pay periods in a year.  So a thousand gross a week is $52,000 income.  If you lose your job tomorrow, your current income tomorrow is Zero, no matter how much is on your most recent tax return.  Tax returns are about the past.

 

Your current income is NOT marginal, based on what you wrote, unless your household really is about 7 or 8.

 

Your current income is also not $37,800.  It's probably more like $57,000

I don't think so.  The spouse is from Thailand, not India.  The current income is over $50,000 and I'm pretty sure the household size is less than 5.  The OP would be wise to clarify the actual household size though.

Ah, now I realize the income quoted by the OP was for 8 months, not 12.  He did mention a household of 5 however.

He said that income was enough for 5.  He did not say anything directly about his actual household size.  I prefer not to assume.
