EAD RFE for NSEERS

Finally got the touch on eAD but turns out to be a RFE. But the language is confusing-

Here is what it is requesting-

Submit evidence that you have registered in NSEERS. Evidence should include, but is not limited to a copy of both sides of the I-94 and visa. If you feel you are not subject to this requirement, submit an explaination with supporting evidence.

The RFE states teh requires for NSEERS registration are 1) Born on or before Dec 2, 1986, AND 2) Admited to the US on or before Sept 30 2002, AND 3) remainded in the US at least until Jan 10 2003

If I am reading this correctly, my husband is exempt from NSEERS because though he was born before 1986, he was not addmitted to the US until Feb 2007. Am I reading this correctly?

Also there is a list on the RFE of exceptions- one reads "Aliens who should have been, but were not, registered by the inspecting officer upon arrival at teh POE. This includes aliens who were inspected and admitted to the US as nonimmigrants after september 2002" So is this our response?

There is an ICE office just blocks away, but do they allow the public to go for questions? Would they even know what CSC wants? would we be better off with an Infopass appointment?

so no takers? I know it is a problem that only a small group of VJers are likely to have experience with. I called USCIS this morning. The first woman told me she couldn;t tell me anything and I would have to talk to an immigration lawyer. I asked if someone at an info pass would be able to help, she said probably not. I need an attorney. :wacko: So knowing what I know about the "misinformation" line, I called back. This time a very helpful woman explained that If I sent a copy of the I-94, the K-1 visa and a copy of the AOS NOA receipt with an explaination of our timeline, that should settle everything.

Seems MSC doesn;t know we filed for AOS (even though everything was sent together to them first) and asking if NSEERS applies to us or to show proof it doesn;t. ARRGGGG

Anyway, everythign is in the maiil, so I will let everyone know if what we sent in works!

Any ideas on why this may have come up for you, and also for yassmine yesterday at DORA when we've never heard of it before with Moroccans?

Either you guys are really unlucky, or there's been a policy change, no?

Havn't had much time to process it that far, concentrated on resolving it first, then concentrate on the hypothetical reasons :lol: . I saw Yassmine's post. Our RFE was dated June 6. First guess is that a memo of some sort was issued recently by USCIS and it is fresh on the minds of USCIS officials. Morocco was added to the list of required countries a while back so that isn't going to account for the new attention. Maybe it has something to do with the recent consulate closing and security measures put in place?

The only thing I see that Yassime and I have in common is Texas. she's filing in Dallas (with Dora) and our local office is Houston, BUT OUR EAD and AP isnt at the Houston office, its at MSC.

What I don't get is this- I was told if you have a I-94 then you were registered with NSEERS. The DHS website also states that if you file a petition with USCIS you may have to show proof of registration. USCIS is part of DHS so if you are registered, then shouldn't it show up in the computer? Why ask for proof? But even more importantly, if it is a requirement for the EAD and AP application to send a copy of the I-94 and Visa, why ask to prove you are registered with NSEERS by sending in a copy of the 1-94 and visa, since they obviously have it already.

Maybe they lost our I-94 and visa copy or didn't know what they were looking at in the stak of evidence so just asked again to be thorough.

There are a few of us waiting for AOS with a Moroccan spouse who all filed recently. Wonder if we will see it for any one else or this is our unlucky turn in the journey
