I left both blank because for “self” I assumed they didn’t apply. (I already got my NOA). Tbh I think either way, it’ll be fine.

Hi all, 

I was wondering if anyone could help me regarding a health insurance question on this form?

 

If you answered "Yes" to Item Number 15., when does your health insurance terminate or date that it must be renewed?

 

So I do have health insurance, through my wife's work as her spouse, but there is no exact date when it will be renewed. The company she works for (Oracle) asks her to update her benefits selected towards the end of the year...but there is not a renewal date, her health insurance doesn't terminate or need renewing exactly until she leaves. So not sure what I should put here?

I had this problem too.  That was one of the things I left blank at first because we are the same way.  I called the insurance company and they were able to tell me the date that the policy would end if I resigned or retired instead of being automatically renewed.  I am a teacher, so for me, it is in the summer.  I would guess for your wife it might end on 12/31 or 1/1 of each year.  I would say if you can't get an answer from them to list whenever the open enrollment you refer to above ends for the year.  Then you can also write a note at the end that explains that it is automatically renewed and in place as long as she remains an employee.  Not sure if this is 100% right but it's what I came up with and at least I got an NOA1 so far!

Yes that is what we will probably do. So did you get a RFE after leaving it blank first time? Did you supply proof of the automatic renewal, like an email? In the instructions of the I-944 it asks you to provide documentation of when insurance renews/expires so not sure what to provide as evidence...

I did not get an RFE.  My forms got complete rejected twice with a very general rejection letter so I don't know exactly what it was that caused the rejection. 

 

Re the insurance: I asked the insurance company when I called them for a letter like you describe as I saw that too and they said they did not have that.  I included proof of enrollment and summary of coverage as well as his insurance card as our evidence, and the note I mentioned explaining that we don't have a specific end date since I couldn't get the letter.  Not sure what will happen with that, hoping it will be enough!

We are nearly ready to submit our AOS package. For the I-944 i have been unable to get my school certificates due to exam boards being closed , so I included a screenshot from the website stating they are closed and an email I received from the same exam board. This also means I am unable to provide proof of my English proficiency (despite myself being a native english speaker, born & raised !). 

I read on another immigration website about  The TOEFL iBT® English Language Test. I was wondering if anyone on here has experience of taking this test? Will it be accepted by USCIS? I don't want to get a RFE so at a loss what to do...

Hi Sean,

 

I took this test when I came in the US the first time because it was a requirement to get in the university. It's not bad and specifically if you're a native english speaker. In your case I wouldn't bother taking it. It would put you at least a good month behind to not even know if it's necessary in your case. Maybe you could reach it to some of your previous English professor for them to send you a sworn statement that you pass your english class with flying colors?

I'm not sure if you ended up going to school in the US too but if you did there is a line on the form i-20 that state "student is proficient in English", I included that as well.

 

I hope you guys can send your AOS soon. We just submitted mine on Saturday, now the waiting game has started..

I have a few questions about this form, and I haven't seen anyone else post that has the same situation yet. My apologies in advance if I sound frustrated w/ this form, it just seems crazy to have to fill this out for a kid when I didn't have to do it for my wife. My wife just got her GC and her paperwork was all submitted long before this form was required. Her 12 yr old son is now here on a K-2 follow to join, and we're filing for his AOS. She didn't have to do an I-944, but he apparently does need one (even being 12 yrs old?) apparently. I didn't see anything indicating that the K-2 could skip this form if the principal applicant had already gotten through that step unfortunately. 

 

So at this point, I'm the preparer of the form and have a few parts that I need some clarification on, I'll list them below.

 

-Part 3 Q.1 I haven't filed for 2019 taxes yet as the deadline is now July 15. Do I need to put that I filed my Federal Taxes? Or should I put No and then clarify below that I plan to file before the due date this year?

 

-Part 3 Q.9-10 My wife's son obviously has no assets or liabilities, so nothing to list there. I have money in my bank acct but no assets of value to speak of. I read that I would potentially need to attach a YEAR's worth of bank statements? Can someone verify if that's really the case? It just seems kind of excessive to send a year's worth of bank statements. Also, do I need to list all my liabilities or is that only for the applicant? The applicant is the one that they're trying to make sure won't be a 'drain on society', so it doesn't seem like I should need to list my loans, cc debt, etc.

 

-Part 4 Q.3A I'm assuming I just need to list his most recent grade completed, but since it was in the Philippines, there's really not any documentation I can send. I'm not sure what documentation they're looking for exactly, so any insight would be appreciated. 

 

-Part 4 Q.5A My wife's son speaks quite good english, but would not technically be considered fluent. Should I enter his 6th grade school english classes that he takes (even though there's not a certification or anything)? There's not any courses or anything that he's actually taken specifically for english, they teach it and speak it a lot in Philippines, but nothing certifiable necessarily.

 

Sorry for all the questions, hopefully someone can point me in the right direction on these. Hopefully this will be useful for someone else in my situation as well. Thanks in advance!

I do not know if your wife's son HAS to file the I944.. but it sounds like you've done your research, so here is how I would answer the above questions.

 

Part 3, Q1. For your wife's son check NO, then check 'Other' and write the applicant is not required to file because he is 12 years old and recently entered the US on a K2 visa. 

When you answer this question for yourself check NO, then select plan to file before the due date for this year. In the section below write that the 2019 tax deadline has been extended to July 2020.

(From memory, you have to fill this section out for everyone in your household- but I'm not sure for K2)

I have attached an example of what I wrote for this section.

 

Part 3, Q9-10. I would only list assets if your household income is below 125% of the poverty line for your household size. Ideally, it makes for a stronger case if your income is 250% above the poverty for your household size. But 125% is the minimum requirement. If your households income is below 125%, you will need to list assets. And yes, if you list savings accounts you need 12 months of statements... if you read the instructions for this section it makes things more clear regarding household income requirements.

Liabilities is only for the applicant (not you).

 

Part 4 Q3A. Yes- list most recent grade completed. If you don't have any evidence, just write in the additional comments that no documentation is provided for someone at that age. If you wanted, I assume you could supply school registration papers if you have access to those?

 

Part 4 Q5A. There is no harm in entering his grade 6 English classes. Again, just give an explanation to the best of your ability.

Yvette, thank you so much for your response, this is very helpful. I probably should have made it more clear that I'm not 100% sure if we actually do need to do this for him given the circumstance of her already being here. I just couldn't find anything saying that he is exempt from doing it, so I assumed it was probably just something we'd have to submit. I'm sure at worst if we submit it unnecessarily, they'll just throw it out anyway, so I guess I'd rather be safe than sorry.

 

Thank you for your help on Part 3 Q9-10, I was just a little leery of leaving a whole section of that blank. Mostly bc it states that it's household Assets and resources instead of personal, with this line "If you are a child, provide any assets available from your parents/legal guardian, providing at least 50% of your financial support." I'm above 250% of the poverty line, so would they just take that into acct from the earlier part of the form, or the I-864 maybe? I did read the instructions for this part of the form, but didn't see anything talking about the poverty line in this section. Again, mostly just nervous about leaving a section blank is all. 

 

Anyways, thanks again for your help. Hoping this can be the last bump in the road (at least for now) to getting my little family settled in here :)

Hi all, 

 

I need to submit proof I don't have a credit report for the I-944 form. I have just created an account with Experian and filled in all the relevant information, including my SSN which I do have. I just wanted to confirm this is the correct information I need to print to prove I don't have a US credit report? I'm slightly confused because it looks like I haven't finished creating my account as it says Step 3 & 4 haven't been completed, even though I filled in all the information they asked for? Does this look correct to people who did the same as I am doing?

I wrote a letter to the credit agency requesting that I do not have a report and 3 weeks later Equifax sent me back a report. (I DONT have a SSN, and was still able to request it). Have you tried writing to them?

When I read over the instructions for I944, I couldn't see anything that said K2 is exempt from filing I944 even with their mother already in the US. If I was in your position, I would probably also file it just to be safe.

 

Yes- if you are above 250% they would take that into account from the earlier part of the form and from your I864.

With the line... "If you are a child, provide any assets available from your parents/legal guardian, providing at least 50% of your financial support." The way I would interpret this is that IF your household income is not >125% of the poverty line, then as a child you need to provide your parents assets to help make up the difference. In your case as your income is above 250% the poverty line for your household size, I would think you need not worry about filling out this section. I would not leave it blank though... Type/print N/A on each line. (Please remember this is my personal interpretation and don't make any final decision on what to write that you are not completely comfortable with).

 

With that said, if you feel more comfortable writing something in this section, you can. Perhaps just list substantial assets e.g. your home (if you have one). Full disclosure, my spouse and I were also above 250% but we chose to list our house anyway, in the hope it would make us look more "stable" financially, so to speak. Again, I did not list our home as an asset because I had to but because I felt it would give me better credibility (I figured it wouldn't hurt!). I hope that makes sense, and I hope I haven't confused you. Just know that if you choose to include an asset like a home, it requires more evidence to be submitted.

 

I do hope you are able to get this filed soon and can enjoy some quality time with your family without the stress of paper work.

No I was under the assumption that it would come up straight away as an error and that I don't have a credit report. I was going to submit that as proof of no credit report. Not sure what I can do now...

Try TransUnion or Equafax website.. see if they give you a different error message. You can still write to them if you wanted. But it will take 3 weeks to get a response.
