This is all such a big cluster you know what! Just anything to make it harder for the people trying to do it legally.

d. (U) Alien Seeking Admission as K Nonimmigrants: K nonimmigrants and their petitioners are not permitted to complete form I-864. You may request a K applicant complete Form DS-5540 to assist in evaluating likelihood of becoming a public charge. Note that K applicants will again be assessed under the public charge ineligibility by USCIS at the time of adjustment of status where the K nonimmigrant seeking adjustment of status will be required to submit a Form I-864.

They have the option to request it for K-1. Whether or not they do might depend on the embassy or circumstances. The I-944 required for AOS applications now will cover a lot of the same questions. Guess it's best to wait for instruction from the embassy. Fill it out beforehand if you're worried I guess?

Hi guys,

Since DS-5540 officially implemented for beneficiary of k1 visa. So, is there anyone in VJ has already had any experience on filling in the quetionnaire ? Because I have  confusion on which part is applicable for k1 and whis part isn't applicable. Kindly give me advice about it.

Thanks in advance.

Hello, I've just emailed Jakarta embassy on this. They responded no. So I believe K1 visa is not required to submit DS 5540.

I think the first round (or few weeks) of ppl going to interviews will bear the brunt of the confusion.

From my reading, the K1 is not held to the same standard because K1 use the I-134 and not the legally binding I-864.

So as posted above, the CO MAY want to see it, in addition to the I-134.  But the I-134 is not legally binding on the petitioner and uses lower income numbers.

Until the consulates update their required K1 visa paperwork pages, I would fill it out just in case.

Here is my take. Take it any way you want. Yes, this could be viewed as a cluster, or more work, or miss understandings or even confusion.

This is just another document that you must fill out to pay "the man with the gold who gets to make the rules" with. No one is complaining about having to fill out any other form, like the I-134, but this form everyone is blowing up about it.

This is where you have to rely on your common sense and be a realist. It has to be completed for many of the embassies. If you don't know if your's require it, fill it out and bring it with you to the interview, avoiding getting a 221(g) and having to fill it out after the interview and return the same to the embassy. Now another 2-3 weeks wait for the issuance for your visa.

So stomping your feet is not going to make this go away. Say what you want about my post, I am just flipping the coin and revealing the other side. Now back to answering additional questions.  :D

I live in New York and am petitioning my 6 years old son who lives in Egypt. The counselor asked him to fill up DS 5540 and send it back to the embassy. Will that affect his decision?

I think, if the embassy requested it, then it means it will somehow affect the decision

Not sending the document will affect the decision. Sending one, at his age, will not contain any derogatory information that could harm is visa application. No problem in filling one out. Where a question is asked and it doesn't pertain to him then add "N/A? to the answer.

We need a little housekeeping on your end. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine their Embassy. The country that should be used is the country where the interview will take place.

So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

Go to the top right of this page select your name (it's on the upper right-hand corner)>my profile>[below your picture on the right column] edit my profile. Scroll to the bottom and fill in "Immigration Info". There now we can better serve you.

Once you finish that then return and you will see a flag in your profile. Select it and see what wonderful information will open up for you.

Thanks

Hi all,

Update from Singapore Embassy - DS 5540 required for interviews here. Mine is scheduled for coming Tues 17th, and I only received notification yesterday.

They had sent the email with my interview appt date/time less than a week ago, and now another email, that's no different from the previous, just with the addition of this paragraph:

Please complete the attached Form DS-5540, Public Charge Questionnaire and bring this form for your interview. You need only complete one form for yourself and your derivative applicants.

I received a PDF version of this form, and will be scrambling to put together my fiance's employment provided coverage, and hopefully my tax statement in 3 days.

Information seems vague on how exactly to fill up this form. The section for expected household size is confusing: Do they mean with my fiance, and his daughter? Or if it's for family coming with me on the K1? (which I do not)

Please help!

Many thanks in advance
